In statements supporting the bill, Democratic Massachusetts Rep. Jake Auchincloss called TikTok "a tool of censorship and propaganda" for the Chinese Communist Party, and Republican Nebraska Rep. Mike Flood said the app has "been used as a tool of propaganda in our country." Still, the federal appeals court wrote in its majority opinion that the government did not present any evidence that China has tried to manipulate content on TikTok in the United States. "The Government acknowledges that it lacks specific intelligence that shows the PRC has in the past or is now coercing TikTok into manipulating content in the United States," the opinion says, referring to the People's Republic of China. However, the government argued in court that ByteDance and TikTok have censored content at China's request in other countries. The appeals court wrote that TikTok "never squarely denies" that it has ever manipulated content on its platform at China's request, which it says is "striking" given the intelligence community's concerns. The court concluded that Bytedance and TikTok have "a demonstrated history" of manipulating content in other countries, sometimes at the request of China. "That conclusion rests on more than mere speculation," the judges wrote in the court opinion. "It is the Government's 'informed judgment' to which we give great weight in this context, even in the absence of 'concrete evidence' on the likelihood of PRC-directed censorship of TikTok in the United States." TikTok argued in court that its "recommendation engine," or algorithm, is not based in China because it is . The court said that while this is correct, ByteDance still controls the source code for TikTok, including the recommendation engine. "TikTok is therefore correct to say the recommendation engine 'is stored in the Oracle cloud,' but gains nothing by flyspecking the Government's characterization of the recommendation engine still being in China," the document says. A TikTok spokesperson said in a statement to Business Insider that the TikTok ban "was conceived and pushed through based on inaccurate, flawed, and hypothetical information, resulting in outright censorship of the American people." "The Supreme Court has an established historical record of protecting Americans' right to free speech, and we expect they will do just that on this important constitutional issue," TikTok said in the statement. Green light for huge new truck showroom and workshop at iconic former industrial siteThe Associated Press Kroger and Albertsons’ plan for the largest U.S. supermarket merger in history crumbled Wednesday, with Albertsons pulling out of the $24.6 billion deal and the two companies accusing each other of not doing enough to push their proposed alliance through. Albertsons said it had filed a lawsuit against Kroger, seeking a $600 million termination fee as well as billions of dollars in legal fees and lost shareholder value. Kroger said the claims were “baseless” and that Albertsons was not entitled to the fee. The bitter breakup came the day after two judges halted the proposed merger in separate court cases. U.S. District Court Judge Adrienne Nelson in Oregon issued a preliminary injunction Tuesday blocking the merger until an in-house judge at the Federal Trade Commission could consider the matter. An hour later, Superior Court Judge Marshall Ferguson in Seattle issued a permanent injunction barring the merger . Ferguson ruled that combining Albertsons and Kroger would lessen competition and violate consumer-protection laws. The companies could have appealed the rulings or proceeded to the in-house FTC hearings. Albertsons’ decision to pull out of deal instead surprised some industry experts. “I’m in a state of professional and commercial shock that they would take this scorched earth approach,” said Burt Flickinger, a longtime analyst and owner of retail consulting firm Strategic Resource Group. “The logical thing would have been for Albertsons to let the decision sink in for a day and then meet and see what could be done. But the lawsuit seems to make that a moot issue.” Albertsons is unlikely to find another merger partner because it has significant debt and underperforming stores in most of its markets., Flickinger said. Consumers will feel the most immediate impact of the deal’s demise, he said, since Albertsons charges 12% to 14% more than Kroger and other grocery rivals. “They had so much debt they had to pay it off it’s reflected in their pricing and promotional structure,” Flickinger said. Albertsons CEO Vivek Sankaran testified during the federal hearing in September that his company might consider “structural options” like laying off employees, closing stores and exiting certain markets if the merger with Kroger didn’t go through. “I would have to consider that,” he said. “It’s a dramatically different picture with the merger than without it.” But in a statement Wednesday, Sankaran said Albertsons would “start this next chapter in strong financial condition with a track record of positive business performance.” In the company’s most recent quarter, Albertsons’ revenue rose 1% to $18.5 billion and it reported $7.9 billion in debt. Kroger and Albertsons first proposed the merger in 2022 . They argued that combining would help them better compete with big retailers like Walmart, Costco and Amazon, which are gaining an increasing share of U.S. grocery sales. Together, Kroger and Albertsons would control around 13% of the U.S. grocery market. Walmart controls around 22%. Under the merger agreement, Kroger and Albertsons — who compete in 22 states — agreed to sell 579 stores in places where their locations overlap to C&S Wholesale Grocers , a New Hampshire-based supplier to independent supermarkets that also owns the Grand Union and Piggly Wiggly store brands. But the Federal Trade Commission and two states — Washington and Colorado — sued to block the merger earlier this year, saying it would raise prices and lower workers’ wages by eliminating competition. It also said the divestiture plan was inadequate and that C&S was ill-equipped to take on so many stores. On Wednesday, Albertsons said that Kroger failed to exercise “best efforts” and to take “any and all actions” to secure regulatory approval of the companies’ agreed merger transaction. Albertsons said Kroger refused to divest the assets necessary for antitrust approval, ignored regulators’ feedback and rejected divestiture buyers that would have been stronger than C&S. “Kroger’s self-serving conduct, taken at the expense of Albertsons and the agreed transaction, has harmed Albertsons’ shareholders, associates and consumers,” said Tom Moriarty, Albertsons’ general counsel, in a statement. Kroger said that it disagrees with Albertsons “in the strongest possible terms.” It said early Wednesday that Albertsons was responsible for “repeated intentional material breaches and interference throughout the merger process.” Kroger , based in Cincinnati, Ohio, operates 2,800 stores in 35 states, including brands like Ralphs, Smith’s and Harris Teeter. Albertsons , based in Boise, Idaho, operates 2,273 stores in 34 states, including brands like Safeway, Jewel Osco and Shaw’s. Together, the companies employ around 710,000 people. Kroger sued the FTC in August in federal court in Ohio, claiming that the federal agency’s in-house administrative hearings were unlawful because the FTC was also able to challenge the merger in federal court in Oregon. In paperwork filed Wednesday, the FTC said it expected to update the court on its next steps in that case by Dec. 17. In Colorado, which also sued to block the merger, Attorney General Phil Weiser said Tuesday that he still was awaiting a decision from a state judge. In that case, Colorado also was challenging an allegedly illegal no-poach agreement Kroger and Albertsons made during a 2022 strike. The twin threats to the strategically vital city of Homs and the capital, Damascus, now pose an existential danger to the Assad dynasty’s five-decade reign over Syria and the continued influence there of its main regional backer, Iran. The rebels’ moves around Damascus, reported by an opposition war monitor and a rebel commander, came after the Syrian army withdrew from much of the southern part of the country, leaving more areas, including several provincial capitals, under the control of opposition fighters. If the insurgents capture Homs, they would cut the link between Damascus, Assad’s seat of power, and the coastal region where the president enjoys wide support. In a post on the social media X (formerly Tweet) Narvekar, who is also a long-term personal assistant to his party chief Uddhav Thackeray, quoted the late Bal Thackeray as stating that he is proud of those who demolished the masjid. For good measure Narvekar included a picture of the demolition and also photos of himself, Uddhav Thackeray and Aaditya Thackeray. The post was to mark the 32nd anniversary of the demolition which was followed by massive communal riots in Mumbai and other parts of the country. The post has exposed a major faultline in the MVA. It won't be surprising if the Congress decides to pull out of the MVA. pic.twitter.com/3nZYC4EK0e Senior MLA of the Congress Amin Patel told the FPJ n Saturday that the X post was not in keeping with the coalition dharma and was most unacceptable. He said the matter will be taken up at the highest level of the Congress. Senior Congress leader and former minister Arif Naseem Khan said it was shocking that Narvekar was openly applauding those who carried out the demolition. "Uddhav Thackeray should immediately clarify whether he agreed the post. I will escalate the matter with my party leadership. The Shiv Sena (UBT) cannot be a part of the MVA and yet adopt the line of the BJP." Spokesperson of the Maharashtra Pradesh Congress Committee (MPCC) Atul Londe said "our alliance with the Shiv Sena (UBT) was based on a common minimum programme aimed at ousting the BJP and defending the Constitution. We do not believe in the politics of religion." However, it is learnt that the Congress leadership is under pressure from the rank and file to snap ties with the Shiv Sena (UBT). Their fear is that the party will not get votes of Muslims in the elections to the BMC which may be declared any day now and this will adversely affect its poll prospects. According to sources, Narvekar, who is the Man Friday of Uddhav Thackeray, would not have done the controversial X post without the concurrence of his boss. The post appears to be a part of the party's efforts to reclaim the Hindutva agenda which was heavily compromised because of its alliance with the Congress and the NCP (Sharad Pawar). The Shiv Sena (UBT) benefited in a big way during the Lok Sabha elections when Muslims supported it and other MVA allies. However, this fact was highlighted by the BJP during the assembly election campaign. The BJP accused the Shiv Sena (UBT) of appeasing the Muslim bank a la the Congress. BJP-inspired social media was very active in the run up to the assembly elections in portraying the Shiv Sena (UBT) as another version of the Congress which has often been accused of pandering to Muslim interests in the name of secularism. BJP supporters pointed out that Uddhav even felt shy of calling his father Bal Thackeray "Hindu Hriaday Samrat" lest he lose Muslim votes. The BJP also highlighted the fact that when the Wakf Amendment Bill was introduced in Parliament Shiv Sena (UBT) members were conspicuous by their absence. The Shiv Sena (UBT) is afraid that if the narrative about the party being pro-Muslim is continued then it will have to pay a heavy price in the BMC elections. With an obvious effort to counter that narrative it appears to have asked Narvekar to go ahead with the controversial post. "Narvekar wont dare do anything without the endorsement of Uddhav. So his X post appears to have been done with the full knowledge of Uddhav," a Sena source observed. Despite the raging controversy neither Uddhav nor Aaditya, who is the second most important leader in the party have distanced themselves from Narvekar's controversial post.
North Korean leader Kim Jong Un vowed to implement the “toughest” anti-U.S. policy, state media reported Sunday, less than a month before Donald Trump takes office as U.S. president. Trump’s return to the White House raises prospects for high-profile diplomacy with North Korea. During his first term, Trump met Kim three times for talks on the North’s nuclear program. Many experts however say a quick resumption of Kim-Trump summitry is unlikely as Trump would first focus on conflicts in Ukraine and the Middle East. North Korea’s support for Russia’s war against Ukraine also poses a challenge to efforts to revive diplomacy, experts say. During a five-day plenary meeting of the ruling Workers’ Party that ended Friday, Kim called the U.S. “the most reactionary state that regards anti-communism as its invariable state policy.” Kim said that the U.S.-South Korea-Japan security partnership is expanding into “a nuclear military bloc for aggression.” “This reality clearly shows to which direction we should advance and what we should do and how,” Kim said, according to the official Korean Central News Agency. It said Kim’s speech “clarified the strategy for the toughest anti-U.S. counteraction to be launched aggressively” by North Korea for its long-term national interests and security. KCNA didn’t elaborate on the anti-U.S. strategy. But it said Kim set forth tasks to bolster military capability through defence technology advancements and stressed the need to improve the mental toughness of North Korean soldiers. The previous meetings between Trump and Kim had not only put an end to their exchanges of fiery rhetoric and threats of destruction, but they developed personal connections. Trump once famously said he and Kim “fell in love.” But their talks eventually collapsed in 2019, as they wrangled over U.S.-led sanctions on the North. North Korea has since sharply increased the pace of its weapons testing activities to build more reliable nuclear missiles targeting the U.S. and its allies. The U.S. and South Korea have responded by expanding their military bilateral drills and also trilateral ones involving Japan, drawing strong rebukes from the North, which views such U.S.-led exercises as invasion rehearsals. Further complicating efforts to convince North Korea to abandon its nuclear weapons in return for economic and political benefits is its deepening military co-operation with Russia. According to U.S., Ukrainian and South Korean assessments, North Korea has sent more than 10,000 troops and conventional weapons systems to support Moscow’s war against Ukraine. There are concerns that Russia could give North Korea advanced weapons technology in return, including help to build more powerful nuclear missiles. Ukrainian President Volodymyr Zelenskyy said last week that 3,000 North Korean troops have been killed and wounded in the fighting in Russia’s Kursk region. It was the first significant estimate by Ukraine of North Korean casualties since the North Korean troop deployment to Russia began in October. Russia and China, locked in separate disputes with the U.S., have repeatedly blocked U.S.-led pushes to levy more U.N. sanctions on North Korea despite its repeated missile tests in defiance of U.N. Security Council resolutions. Last month, Kim said that his past negotiations with the United States only confirmed Washington’s “unchangeable” hostility toward his country and described his nuclear buildup as the only way to counter external threats.
