
The family of a 9-year-old boy who died several years after hitting his head on a metal cart holder at Walmart is now suing the superstore for allegedly creating a dangerous and unsafe condition that ultimately led to the boy’s death. According to a complaint, Tamika Springer is seeking damages beyond $30,000 for the death of her son , Saiy-Yah Allen. During a trial hearing on Tuesday, Saiy-Yah’s sister spoke about how her brother experienced seizures after the incident at the Florida megastore. According to the sibling, her then-7-year-old brother walked into a metal stock cart and struck his head in a walkway in November 2020, per Law and Crime. “He would shake a lot and he would look in a different direction, and then he would shake and make noise, too,” Miharah Allen said. “Every time he ate, he would throw up, he would throw the food up or use the bathroom on himself.” Florida mom 'left loaded gun' on Disney DVDs and bullets in bed as kids played at squalid home DNA left on discarded cigarette butt solves 40-year murder mystery of Indiana steelworker The testimony of the sibling comes after it was reported by local NBC affiliate WTVJ after Walmart had questioned whether or not the injury led to his seizures and death. “Walmart is not liable for the incident as the stock cart was so open and obvious that S.A. should have been reasonably expected to discover it and protect himself (by simply walking around it), and a stock cart is so obvious and not inherently dangerous that it can be said, as a matter of law, not to constitute a dangerous condition that will not give rise to liability due to the failure to maintain the premises in a reasonably safe condition,” the defendant’s motion for summary judgment said . “Here, unfortunately, S.A. was inattentive and failed to walk around a stock cart’s handles that were observed by his sister, who was not walking with her head turned. S.A. failed to use his senses and was walking while looking backward, therefore he did not observe the open, obvious, and innocuous stock cart.” According to the boy's obituary, Saiy'yah was "the King that the world deserved but wasn't ready for." According to the site, "His energy filled every room he walked into, and his presence impacted everyone who came in contact with him." The obituary also made reference to some of the boy's passions and hobbies. "Saiy'yah's talents were extraordinary. His drawings, paintings, origami and popsicle sculptures were amazing to everyone that was fortunate to see them or receive a gift from him," it said. "He often made origami birds and drawings for our friends and even random people he came in contact with." "His eyes and smile lit the entire universe! He did everything with the utmost pride and precision," they concluded. We all told him how brilliant and genius he is and how his talents will only get greater." Photo: File photo The four-day work week pilot project for the majority of staff at the Regional District of Okanagan-Similkameen has proven so popular and effective in employee production and retention of staff, that the board has extended it for another year. The six-month pilot project that started in July and is wrapping up at the end of this month has been closely tracked and the results have overwhelmingly positive, said Karmen Morgan, senior manager of human resources for the RDOS. “We’re here to share the experiences and data that has been collected over the past six months of the flexible trial,” she said. The idea for a four-day work week were brought up on numerous occasions due to a longstanding problem with low retention rates amongst RDOS staff, said Morgan. “They were identified as a risk to the organization back in 2021,” she said. “We put together a plan to address the low-hanging fruit in the areas the staff were telling us were challenging for them and what was really important to them in a workplace.” Flexibility was a common theme brought up on a regular basis and discussions began on how to best incorporate this into operations, she said. “In conversations with staff, it also became evident that stress was building and attempts to offset these stressors with training, support and shifting work plans wasn’t having the impact we had hoped in all areas,” she said. Recruiting qualified employees to work in various positions has proven very difficult over numerous years, especially in areas like planning, building inspection and engineering technology, she said. “Gaps in recruitment due to these difficulties puts more pressure on employees who are here and are required to juggle multiple roles,” she said. There are managers and senior administration who work on “exempt teams” that are forced to work excessive overtime to fill in workload gaps in order to achieve results, she said. When time and effort was taken to look into what a more flexible, four-day work week could achieve, information was gathered from organizations that specialize in this work model to develop a business case how shifting the traditional work schedule could yield positive results, said Morgan. “If we could find a way to reduce the constant recruiting, lower the stress levels for existing staff who have been struggling to achieve results without a full team, improve their wellbeing in the process and streamline existing systems, this sounded really too good to be true,” she said. “Given where we were in our retention metrics, we, along with the board, recognized it was time to try something new.” It was decided that work targets still had to be met, but were achievable if employees were more productive during the shorter work week, she said. “We knew this was a major undertaking to change our mindsets,” she said. A consultant from a company that works with organizations all over the world looking at the flexible work model was brought in to give advice and monitor progress when the pilot project began, she said. “She helped guide the transition that many organizations around the world have done and are doing now,” she said. There’s no getting around deadlines required for projects to be completed for staff, but results have shown that before four-day scheduling, there were imbalances that people were reporting, she said. “The amount of overtime has decreased significantly from union staff, which was mildly surprising and does save money,” said Morgan. There has been a 30 per cent drop in employees leaving the organization in 2024, which is significant and very beneficial and can be attributed to the reduced work week, she said. “We hear from staff, not only in the survey, but in conversations, about the appreciation for having more time for other aspects of their lives and how differently they feel about their work environment since starting the trial,” she said. Summerland Mayor Doug Holmes told the board the district just finished its own 18-month pilot project where staff could opt to work a compressed four-day work week, but working the same amount of hours, and it was so popular it was recently adopted permanently. Director Riley Gettens said the pilot program doesn’t extend to RDOS managers and she would like to see the flexible work week offered to them as well. Offering flexible work weeks has become a significant recruiting tool for organizations like the RDOS and he’s impressed with the results of this pilot project, said director Richard Barkwill. The board voted overwhelmingly in favour of continuing the pilot project through 2025. ATLANTIC CITY, N.J. (AP) — New Jersey gambling regulators have handed out $40,000 in fines to two sportsbooks and a tech company for violations that included taking bets on unauthorized events, and on games that had already ended. In information made public Monday, the New Jersey Division of Gaming Enforcement fined DraftKings $20,000. It also levied $10,000 fines on Rush Street Interactive NJ and the sports betting technology company Kambi. According to documents released by the state, Rush Street accepted 16 bets worth $1,523 in Nov. 2021 on a college basketball game between the University of North Carolina-Asheville and Tennessee Tech University after the game had already concluded with a UNC victory. Kambi told the enforcement division that a trader had failed to manually remove that game from its betting markets, saying it had stopped receiving messages from its own sports data provider due to a network connectivity error. Kambi said it has updated its guidelines and retrained its traders to prevent a recurrence. Kambi, which is based in Malta, did not immediately respond to a message seeking comment Monday. Rush Street declined comment, and DraftKings had no immediate comment Monday. DraftKings stopped using Kambi in 2021. In March 2022 Rush Street took seven bets totaling just under $2,900 on three Magic City Jai Alai games after the results were already known. Kambi told the division it experienced a connectivity issue that allowed the bets to be accepted after the games were over. An explanation of what Kambi did to address the situation was blacked out in documents released by the division. A month earlier Rush Street took 13 wagers worth $8,150 with pre-match odds on a Professional Golf Association match after the event had already begun. In this case, Kambi told the division a newly hired trader failed to enter the correct closing time time for bets on the event. The trader and a supervisor underwent retraining. DraftKings was fined for taking bets on unapproved events including Russian basketball for nine months in 2020 and 2021. It eventually voided over $61,000 in bets and returned the money to customers after being directed to do so by the state. In this case, Kambi told the division it misidentified this particular Russian basketball league as one that was approved for wagering in New Jersey. DraftKings told the state it did not catch the error, either. In 2020, DraftKings accepted 484 wagers on unapproved table tennis matches. Kambi incorrectly enabled the events for wagering without conditions required by the state, the division said. In Feb. 2022, the division said DraftKings took pre-season NFL bets involving specific players but did not give the state specific information on what information was to be included in the bets, drawing 182 wagers worth nearly $7,000 that were later voided and refunded to customers. Google continues to fine-tune its native apps on Android , this time with Google News. This follows the big redesign to Google Maps that happened earlier this year. So what’s new in Google News? Basically, the newly redesigned Google News makes things simpler in terms of the bottom bar. Previously, there were four sections in that bottom navigation bar: For you, Headlines, Following, and Newsstand. The revamped version now combines For you and Headlines into a new Home tab, which acts as the default feed for content. The other two tabs — Following and Newsstand — still remain. There is also a new categories carousel along the top of the app, where you can access: Headlines, Local, U.S., World, Business, Technology, Entertainment, Sports, Science, and Health. All of these categories were previously found in the Headlines section. This change eliminates unnecessary steps and streamlines your content feed. When you view the category carousel, the selected feed will no longer show an underline. Instead, it basically highlights the category to make it easier to see which feed you’re in. One-handed reachability is not affected by this, but navigation is simplified with the change. Consolidating the Google News bottom bar from four to three tabs is not a new decision from Google, as it also made this change to Google Photos and Google Maps . Not only does reducing the number of tabs in the bottom bars make things simpler but it also looks better due to the minimalism, and feels more elegant for Material You. The Google News redesign is rolling out with version 5.120.x on Android through a server-side update. For iOS Google News users, the new look is not yet live, but should be coming. Unfortunately, though, if you like dynamic color theming on Android, that feature won’t be used in the Google News redesign since it continues to use the blue accent color.
