The crash happened on June 24 about 7am, when a trailer towing a telehandler rolled on the Riverina Highway. The machine came loose from the trailer and hit an oncoming utility, leaving its driver, 64, trapped with critical injuries. Emergency workers cut him free, then paramedics took him to Albury hospital. He was later transferred to a hospital in Melbourne. Defence lawyer Mark Cronin told Albury court registrar Wendy Howard on Wednesday, November 27, that as a result of its decision not to elect, "the DPP has returned the brief" of evidence. "It will need to go to a hearing [in the Local Court]," Mr Cronin said. He said due to the unavailability of Wagga-based prosecutor Sergeant Jason Tozer on Wednesday, a hearing date would need to be set in a week's time. "It's probably a three-day case," Mr Cronin said. Chappell, 51, was not required to attend court on Wednesday, and will similarly not be required for the next mention provided he is again legally represented.
