(WV News) — The West Virginia Secondary Schools Activities Commission won its petition for a writ of prohibition Thursday at the state Supreme Court, nixing rulings from Tyler and Hardy judges and clearing the way for the Class A state volleyball tournament to proceed as the SSAC initially envisioned. The ruling in the volleyball case hinged on the same basic grounds as the ruling earlier this week in which the Supreme Court granted the SSAC a writ for the football playoffs. In that case, the high court found judges in Wood and Mason overreached, just as in Thursday’s ruling the Supreme Court found the Tyler and Hardy judges did the same. “From our review of the circuit court’s reasoning in awarding injunctive relief to Tyler Consolidated, it found that the WVSSAC did not act quickly enough with respect to non-football reclassifications and that court intervention was necessary in the interest of treating male-dominated sports (football) and female-dominated sports fairly. It thus required that the WVSSAC immediately reclassify Tyler Consolidated from Class AA to Class A for volleyball and cheer,” the Supreme Court wrote. But, “it is beyond question that the WVSSAC had the authority to reclassify under West Virginia Code of State Rules §127-3-10. Objections to those classifications were appropriately appealed to the Board of Review, which body is constituted to hear disputes such as those at issue here,” the high court held. “While the circuit court adopted the Board of Review’s conclusion that competitive balance was not achieved in implementing the classification rule because it created safety issues for football, the court went on to usurp the authority of the Board of Review by adjudicating Tyler Consolidated’s challenge to the application of the classification rule to the sports of volleyball and cheer,” the high court found. ‘”We have repeatedly held that the manner in which the WVSSAC applies its rules is not subject to judicial review ... We thus conclude that the circuit court exceeded its authority in adjudicating the as-applied challenge to the WVSSAC reclassification rule, particularly when that as-applied challenge was already litigated and addressed by the appropriate body. “Despite the circuit court’s summary conclusion that the Board of Review’s action with respect to football (a male-dominated sport) and inaction as to volleyball and cheer (female-dominated sports) resulted in male and female student athletes being treated differently, there is no corresponding constitutional equal protection analysis applying any level of scrutiny to the reclassification rule,” the high court found. “To the extent the order granting injunctive relief may be interpreted to have been decided on gender-based equal protection grounds, we find no factual basis to support a gender-based classification and, indeed, the circuit court failed to undertake any legal analysis of an equal protection violation justifying the relief it granted. “Rather, the circuit court fundamentally mischaracterized the Board of Review’s order by stating that it singled out football for immediate reclassification on the basis that it is a male-dominated sport and resultantly discriminates against female-dominated sports. In fact, the Board of Review’s order is replete with references and appendices indicating that football was singled out for immediate reclassification before the season began for concussion and similar injury-related purposes. “The Board of Review’s order also clearly directed that all other sports, including male and female-dominated sports, were to be reclassified after the WVSSAC had an opportunity to identify and address inconsistencies in the December 2023/January 2024 classifications. The urgency of the WVSSAC’s reevaluation of its classifications was drawn on sport lines, not gender ones. Because the order granting injunctive relief constitutes improper judicial intervention in an as-applied challenge to the reclassification rule and a similarly improper usurpation of the WVSSAC’s authority to ‘exercise the control, supervision, and regulation of interscholastic athletic events . . . of secondary schools,’ West Virginia Code § 18-2-25(b), a writ of prohibition is appropriate in Case No. 24-665. “With regard to the November 15, 2024, order of the Circuit Court of Hardy County, we observe that the order was issued in direct response to the Circuit Court of Tyler County’s improper grant of injunctive relief. Republicans plan to renew some $4 trillion in expiring GOP tax cuts, a signature domestic achievement of Trump’s first term and an issue that may define his return to the White House. “We know there are serious discussions about a major tax bill coming out of the next Congress,” Werfel said, “and with the improvements we’ve made since I’ve been here, I’m quite confident the IRS will be well positioned to deliver on whatever new tax law that Congress passes.” Tax collections announced Thursday include $1.3 billion from high-income taxpayers who did not pay overdue tax debts, $2.9 billion related to IRS criminal investigations into crimes such as drug trafficking and terrorist financing, and $475 million in proceeds from criminal and civil cases that came from whistleblower information. The IRS also announced Thursday that it has collected $292 million from more than 28,000 high-income non-filers who have not filed taxes since 2017, an increase of $120 million since September. Despite its gains, the future of the agency’s funding is in limbo. The IRS originally received an $80-billion infusion of funds under the Inflation Reduction Act, though the 2023 debt-ceiling and budget-cuts deal between Republicans and the White House resulted in $1.4 billion being rescinded from the agency and a separate agreement to take $20 billion from the IRS over the next two years and divert those funds to other nondefense programs. In November, U.S. Treasury officials called on Congress to unlock $20 billion in IRS enforcement money that is tied up in legislative language that has effectively rendered the money frozen. The $20 billion in question is separate from another $20 billion rescinded from the agency last year. However, the legislative mechanism keeping the government afloat inadvertently duplicated the one-time cut. Treasury officials warn of dire consequences if the funding is in effect rescinded through inaction. Trump last week announced plans to nominate former Missouri Rep. Billy Long, who worked as an auctioneer before serving six terms in the House of Representatives, to serve as the next commissioner of the IRS. Democrats like Sen. Ron Wyden (D-Ore.) have called Long’s nomination “a bizarre choice” since Long “jumped into the scam-plagued industry involving the Employee Retention Tax Credit.” Trump said on his social media site, “Taxpayers and the wonderful employees of the IRS will love having Billy at the helm.” Werfel’s term is set to end in 2027, and he has not indicated whether he plans to step down from his role before Trump’s inauguration. (AP) — Duke coach Manny Diaz says quarterback Maalik Murphy will face discipline “internally” after extending both of his middle fingers skyward in celebration after throwing a long touchdown pass early in the . Diaz said Monday that Murphy's exuberant gesture, caught on the ACC Network national broadcast, was directed at offensive coordinator Jonathan Brewer in the booth after a bit of practice “banter” from a few days earlier. Diaz said the Texas transfer just let his excitement get away from him but still called it “unacceptable in our program." “There was a practice in the middle of last week when we throwing post after post after post, and we weren't completing them,” Diaz said. “And it was again and again and again and again. And at the end of that, there was a remark made in jest that, ‘If you throw a post for a touchdown in the game, then you can flick me off,’ from Coach Brewer.” Murphy's gesture came after he uncorked a deep ball from deep in Duke's own end and caught Eli Pancol perfectly in stride across midfield, with Pancol racing untouched for an 86-yard score barely 2 minutes into the game. Only four teams are left in the 2024 MLS Cup Playoffs, and on Saturday they'll battle it out to earn a spot in MLS Cup on Saturday, December 7. Orlando City SC and NY Red Bulls are the last teams standing in the East, with Los Angeles Galaxy and Seattle Sounders fighting for the Western Conference crown. Behind them, the midfield pairing of Wilder Cartagena and César Araujo aren't the most creative duo, but they're incredibly hard-working and combative, setting the tone for how Orlando approach the game. Most importantly, goalkeeper Pedro Gallese has hit his stride in the postseason. The Peru Football international has allowed just one goal all postseason, and while he's benefited from a lock-down defense in front of him, he's stepped up when called on. On the other side, NY Red Bulls have hit their stride in the postseaso n. After sweeping the Columbus Crew SC in Round One, the Red Bulls dispatched New York City FC on the road in their conference semifinal match-up, with goals from Felipe Carballo and Dante Vanzier giving them an early and ultimately unassailable lead. As typical for a Red Bulls team, they base their game model around a high press with heavy emphasis on winning second balls and tackles in the attacking half, leading to plenty of turnovers close to goal. It's worked for them against two of the more possession-based teams in the MLS Eastern Conference , but Orlando pose a very different challenge. With both sides better against the ball than with it, it's hard to pick out a clear protagonist heading into things. Both Orlando and New York are more than capable of winning battles in midfield, but the Red Bulls have the edge when it comes to turning won tackles into ball progression. It looks like being a tight (and possibly ugly) match, but the Red Bulls have already beaten better opponents this postseason. Los Angeles Galaxy have been nothing short of dominant in the postseason. The swept the Colorado Rapids in Round One by an aggregate 9-1 scoreline and breezed past Minnesota United in the conference semifinals in a 6-2 route. Riqui Puig had a reasonable case to be the best player in MLS during the regular season, and he has upped the ante in the playoffs with a total of four goals and two assists. The entire team revolves around the FC Barcelona academy product, with Joseph Paintsil and Gabriel Pec consistently making daring runs into space, knowing that Puig has the ability to find them. While their defense has been called into question all season, they've allowed just three goals and 0.87 expected goals per match, the second-lowest of any playoff team per American Soccer Analysis . ( Orlando City SC lead all playoff teams with 0.81 per match). Their ability to absolutely dominate teams in the final third, build out from the back, and simply outscore opponents no matter the scenario, make them the heavy favorites to lift MLS Cup at this point. Seattle Sounders weren't a trendy pick to make it this far, but they've absolutely earned their place with wins over Houston Dynamo and a heavily-favored Los Angeles FC side. Their defense has been the story of their 2024 campaign, allowing just 35 goals in the regular season, and a league-best 1.20 expected goals per game in the regular season and playoffs, per ASA. Stefan Frei has rediscovered his best form, impressing against LAFC behind an absolutely dominant defense. Yeimar Gómez and Jackson Ragen have developed into one of MLS's premier center-back duos, but Yeimar is a doubt for Saturday's match after coming off injured against LAFC. Nouhou Tolo and Reed Baker-Whiting are also battling injuries and illness, potentially depriving head coach Brian Schmetzer of three of his more important players. As good as Seattle's defense is, it's hard to see them keeping Puig & Co. quiet for a full 90 minutes. And while Jordan Morris has excelled as a No. 9 this season, the Sounders don't have the firepower to hang with the Galaxy in a shootout, at least on paper. The Sounders will go into the match looking to keep things tight and compact for as long as possible, but if Los Angeles can find an early goal, the game will inevitably blow wide open.
