A two-way tie for a village board seat in Lancaster County remained tied Monday following a recount, but it never came down to a coin toss. Instead, John Juricek conceded the race to his wife, Amanda Fangmeier. In an unusual Election Day outcome, the third seat for the Denton Village Board of Trustees ended in a three-way tie. After provisional and other uncounted ballots were tallied, the three-way tie was reduced to a two-way tie, but the one-vote difference of newcomer Tim Reckling was close enough to trigger the recount. The recount happened Monday morning — with the three candidates present, and Republican and Democrat observers watching Election Commissioner Todd Wiltgen and an employee recount the entire precinct votes so they wouldn’t have to separate the ballots. The three candidates watched from a window into the room with the ballot counting machines, and the party observers stood by one of the machines while Wiltgen and his employee re-tallied the votes. The results of the recount didn’t change the final results, which meant the two-way tie between husband (Juricek, running for his fourth term) and wife (Fangmeier, running for her third) would come down to a little-used portion of state election statutes called “drawing by lots.” Wiltgen, who got to decide on the method of the tie-breaker, said initially that he was leaning toward flipping a coin. But because he had to have the method in place before the recount — and because of the possibility that a recount could have shifted back to a three-way tie — he opted for drawing names. He had a box ready and was going to have the candidates write their names, fold the paper and drop it in the box, and he would draw the name of the winner. But it never came to that. Juricek conceded the race following the recount, and everybody sitting around the table congratulated Fangmeier. She said that even though she and her husband don’t always agree on village board policy, Juricek had decided he’d concede if the recount remained the same — but it was important to him the recount happen. Fangmeier said she’d never heard of such an outcome and called the election commissioner’s office to find out what happened next — and she got to watch the recount, which she found interesting. And now, she’ll serve her third term along with two other village board members elected on Nov. 5. Contact the writer at mreist@journalstar.com or 402-473-7226. On Twitter at @LJSReist. Heritage Distilling Co. Announces Closing of its Initial Public OfferingIsrael approved a United States-brokered with Lebanon’s Hezbollah on Tuesday, setting the stage for an end to nearly 14 months of fighting linked to the ongoing war in the Gaza Strip. In the hours leading up to the Cabinet meeting, Israel carried out its most intense wave of strikes in Beirut and its southern suburbs and issued a record number of evacuation warnings. At least 24 people were killed in strikes across the country, according to local authorities, as Israel signaled it aims to keep pummeling Hezbollah in the final hours before any ceasefire takes hold. Israel’s security Cabinet approved the ceasefire agreement late Tuesday after it was presented by Prime Minister Benjamin Netanyahu, his office said. U.S. President Joe Biden, speaking in Washington, called the agreement “good news” and said his administration would make a renewed push for a ceasefire in Gaza. An Israel-Hezbollah ceasefire would mark the first major step toward ending the regionwide unrest triggered by Hamas’ attack on Israel on Oct. 7, 2023. But it does not address the devastating war in Gaza. U.S. President-elect Donald Trump has vowed to bring peace to the Middle East, but neither he nor Netanyahu have proposed a postwar solution for the Palestinian territory, where Hamas is still holding dozens of hostages and the conflict is more intractable. Still, any halt to the fighting in Lebanon is expected to reduce the likelihood of war between Israel and Iran, which backs both Hezbollah and Hamas and exchanged direct fire with Israel on two occasions earlier this year. Israel says it will ‘attack with might’ if Hezbollah breaks truce Netanyahu presented the ceasefire proposal to Cabinet ministers after a televised address in which he listed a series of accomplishments against Israel’s enemies across the region. He said a ceasefire with Hezbollah would further isolate Hamas in Gaza and allow Israel to focus on its main enemy, Iran, which backs both groups. “If Hezbollah breaks the agreement and tries to rearm, we will attack,” he said. “For every violation, we will attack with might.” Netanyahu’s office later said Israel appreciated the U.S. efforts in securing the deal but “reserves the right to act against every threat to its security.” It was not immediately clear when the ceasefire would go into effect, and the exact terms of the deal were not released. The deal calls for a two-month initial halt in fighting and would require Hezbollah to end its armed presence in a broad swath of southern Lebanon, while Israeli troops would return to their side of the border. would deploy in the south, and an international panel headed by the United States would monitor all sides’ compliance. But implementation remains a major question mark. Israel has demanded the right to act should Hezbollah violate its obligations. Lebanese officials have rejected writing that into the proposal. Biden said Israel reserved the right to quickly resume operations in Lebanon if Hezbollah breaks the terms of the truce, but that the deal “was designed to be a permanent cessation of hostilities.” Hezbollah has said it accepts the proposal, but a senior official with the group said Tuesday that it had not seen the agreement in its final form. “After reviewing the agreement signed by the enemy government, we will see if there is a match between what we stated and what was agreed upon by the Lebanese officials,” Mahmoud Qamati, deputy chair of Hezbollah’s political council, told the Al Jazeera news network. “We want an end to the aggression, of course, but not at the expense of the sovereignty of the state.” of Lebanon, he said. “Any violation of sovereignty is refused.” Warplanes bombard Beirut and its southern suburbs Even as Israeli, U.S, Lebanese and international officials have expressed growing optimism over a ceasefire, Israel has continued its campaign in Lebanon, which it says aims to cripple Hezbollah’s military capabilities. An Israeli strike on Tuesday leveled a residential building in the central Beirut district of Basta — the second time in recent days warplanes have hit the crowded area near the city’s downtown. At least seven people were killed and 37 wounded, according to Lebanon’s Health Ministry. Strikes on Beirut’s southern suburbs killed at least one person and wounded 13, it said. Three people were killed in a separate strike in Beirut and three in a strike on a Palestinian refugee camp in southern Lebanon. Lebanese state media said another 10 people were killed in the eastern Baalbek province. Israel says it targets Hezbollah fighters and their infrastructure. Israel also struck a building in Beirut’s bustling commercial district of Hamra for the first time, hitting a site that is around 400 meters (yards) from Lebanon’s Central Bank. There were no reports of casualties. The Israeli military said it struck targets in Beirut and other areas linked to Hezbollah’s financial arm. The evacuation warnings covered many areas, including parts of Beirut that previously have not been targeted. The warnings, coupled with fear that Israel was ratcheting up attacks before a ceasefire, sent residents fleeing. Traffic was gridlocked, and some cars had mattresses tied to them. Dozens of people, some wearing their pajamas, gathered in a central square, huddling under blankets or standing around fires as Israeli drones buzzed loudly overhead. Hezbollah, meanwhile, kept up its rocket fire, triggering air raid sirens across northern Israel. Israeli military spokesman Avichay Adraee issued evacuation warnings for 20 buildings in Beirut’s southern suburbs, where Hezbollah has a major presence, as well as a warning for the southern town of Naqoura where the U.N. peacekeeping mission, UNIFIL, is headquartered. UNIFIL spokesperson Andrea Tenenti told The Associated Press that peacekeepers will not evacuate. Israeli forces reach Litani River in southern Lebanon The Israeli military also said its ground troops clashed with Hezbollah forces and destroyed rocket launchers in the Slouqi area on the eastern end of the Litani River, a few kilometers (miles) from the Israeli border. Under the ceasefire deal, Hezbollah would be required to move its forces north of the Litani, which in some places is about 30 kilometers (20 miles) north of the border. Hezbollah began firing into northern Israel, saying it was showing support for the Palestinians, a day after Hamas carried out its Oct. 7, 2023, attack on southern Israel, triggering the Gaza war. Israel returned fire on Hezbollah, and the two sides have been exchanging barrages ever since. Israel escalated its campaign of bombardment in mid-September and later sent troops into Lebanon, vowing to put an end to Hezbollah fire so tens of thousands of evacuated Israelis could return to their homes. More than 3,760 people have been killed by Israeli fire in Lebanon the past 13 months, many of them civilians, according to Lebanese health officials. The bombardment has driven 1.2 million people from their homes. Israel says it has killed more than 2,000 Hezbollah members. Hezbollah fire has forced some 50,000 Israelis to in the country’s north, and its rockets have reached as far south in Israel as Tel Aviv. At least 75 people have been killed, more than half of them civilians. More than 50 Israeli soldiers have died in the ground offensive in Lebanon. ___NoneIn the late 1970s, America was not in a good place; reeling from a war and from Watergate. Then came a man called Jimmy. "Jimmy who?" the nation asked. It was the dismissive reaction from many when a peanut farmer called Jimmy Carter announced a run for the White House. Beyond his home state of Georgia, where he had served as Governor, James Earl Carter Jr was not well known. But it would turn out, Jimmy Carter was just what 1970s America needed. After the political turmoil of Nixon and Watergate and the quagmire of the Vietnam War, America craved stability, calm and integrity. More on United States Former US president Jimmy Carter dies US attorney general tried to block Gerry Adams fundraising in 1995 over IRA weapons fears, unearthed records reveal Joe Biden reduces all but three US federal death sentences to life imprisonment Related Topics: United States The 39th president of the United States did not provide the drama of those who came before him or those who would follow him. Yet over a remarkably long life, punctuated by a short presidency, Jimmy Carter built a considerable legacy deserving of considerable reflection. Carter the healer "Compassionate", "honourable", a "peacemaker", a "healer". They are words so often used to describe the American leader who lived a life longer than any other. Late 1970s America was a nation reeling from the Watergate scandal and the disgraced presidency of Richard Nixon followed by the accidental presidency of Gerald Ford. Read more: Former US president Jimmy Carter dies The wider backdrop was a long war in Vietnam, ending in a humiliating defeat and a fresh blot in a proud nation's history. Enter Jimmy Carter, 52-years-old; five feet seven inches - unassuming and unimposing both physically and in character. Peanut farmer, turned submariner, turned politician; he was a man of the people whose core instinct was that a government is only as good as its people. His healing qualities, clearly threaded through his life, were displayed on day one of his presidency. In a bold move he granted unconditional pardons to hundreds of thousands of men who evaded the Vietnam War draft. He had said the pardon was needed "to heal our country after the Vietnam War". Of the bitter divisions sparked by the war, he said: "We can now agree to respect those differences and to forget them." He pioneered a bold vision for compassionate centre-left politics which would, many years later, be emulated by presidents Clinton, Obama and Biden. Yet Jimmy Carter would survive only one term as president. In those four years he faced huge challenges - an energy crisis, Soviet aggression and Iran - themes which, it turns out, endure. A childhood which shaped a presidency Jimmy Carter was born where he died, in the town of Plains, Georgia on 1 October 1924. His childhood unquestionably moulded the person and politician he would become. 1930s Georgia was a place of segregation. Two Americas existed side by side, separated by racism. But Carter's mother, a nurse, boldly ignored the state's segregation laws, and so young Jimmy's upbringing was one of coexistence in a place where there was none. Decades later Carter would tell American talk show host Oprah Winfrey how every one of his childhood friends was black. It was an experience which moulded his mind and would allow him to help change history decades later. Young Jimmy Carter joined the Navy, serving as a submariner - a role that surely takes a particular type of character. His father's death in 1953 brought him back to Georgia where he ran the family peanut farm. But politics beckoned. It was race and racism which lured Carter to activism with the Democratic Party. By the 1960s it would propel him to the state senate and, by 1970, to the top job in Georgia - governor. The long-shot president He was the dark horse for president; a long-shot candidate who made it all the way. His childhood experiences of coexistence over division were threaded through his term in office and led to significant yet oft-forgotten achievements. President Carter recognised and valued the power of American leadership in the protection of human rights. Global achievements It was his blunt message to the white rulers in South Africa which helped to precipitate the end of Apartheid and a peaceful coexistence many years later. His influence in the Middle East was profound, but controversial too. The Camp David accords represented Carter's greatest foreign policy achievement. He brought together Israel and its greatest enemy of the time, Egypt. The image of Carter cupping the clasped hands of Egyptian President Sadat and Israeli Prime Minister Begin on the north lawn of the White House in September 1978 is iconic. It represented the framework on which coexistence in the Middle East continues to be built. With the deal he did more for Israeli security than any American president since, and yet he maintained a compassion for the Palestinian cause that no other American president has come close to. Years later, out of office, he was among the first to accuse Israel of its own apartheid regime against the Palestinians. A presidency dominated by 'events' Under his presidency, the Cold War got hotter. A wary Carter ditched a key arms reduction treaty with the Soviet Union. It would raise tensions but eventually help precipitate the collapse of the USSR. With Britain, he fostered the so-called 'special relationship'; he and British prime minister James Callaghan were close. But 'events' overtook his vision and his presidency unravelled. In Iran, revolution came and US hostages were taken. American diplomats were held hostage for more than a year. A risky rescue ordered by President Carter went wrong, eight US servicemen were killed and Carter was blamed. After just one term, Carter was out. The American people, struggling economically, chose the Republican showman Ronald Reagan and an optimism they could no longer find in Carter. Misjudged by history? History is so often cruel and distorted. It would hand many achievements built by Carter to Reagan instead. It was Carter who laid the foundations for Middle East coexistence, and though he would be let down by partners later, and coexistence seems at times to be very far off, his vision remains at the core of the solution. He has arguably done more to fix to the Middle East conundrum than any other American president since. Be the first to get Breaking News Install the Sky News app for free On the Cold War, it was Carter's decision to ditch the detente with the Soviet Union which would eventually seal its demise. Reagan would not have been able to demand Gorbachev 'tear down this wall' without Carter's leadership in the years before. The Democrat presidents since have often borrowed Carter's core principles and yet the party orphaned him. A legacy beyond politics This 'involuntary retirement', as Carter would later put it, left much undone and it was really only after leaving office that he began to build the legacy he'd want to be remembered for. With his wife, Rosalynn, he founded The Carter Center, a charity with his principle of healing at its heart. Follow our channel and never miss an update The charity's work - conflict resolution, disease prevention and the promotion of democracy - continues to this day. It represents president Carter's legacy in 80 nations around the world. In 2002, it was this work which earned him the Nobel Peace Prize. Since then, under his leadership, its work has helped to nearly eradicate Guinea Worm Disease. As of 2021 there were just 15 cases reported globally. An extraordinary achievement. At home in America, the charity Habitat for Humanity was a central part of the Carters' fundraising efforts. Over many years, Jimmy and his wife were seen building and renovating homes for some of the nation's poorest. And away from this spotlight at his lifelong home in Plains, Georgia, president Carter was a painter, a furniture maker, a winemaker, and an author of a remarkable 32 books. The death of his wife Rosalynn last year must have been an enormous blow for Carter. She had been at his side always, and so often hand in hand. His best friend, his counsel, his 'chief advisor', his wife since 1946. So often over the years, he's been asked to reveal the magic of their bond. His answer: 'never go to bed angry.' 'Always make peace,' he said. In much more than just marriage, that was President Carter's defining principle. He's survived by his four children Jack, James (Chip), Donnel (Jeff) and Amy, 11 grandchildren and 14 great grandchildren.
The Federal Capital Territory ( FCT), Nyesom Wike, has called out the elder statesman, Dr Peter Odili over his recent comments about him and the Rivers State Governor’s political misunderstanding. Wike noted that Odili a respected political figure both in Rivers State and in the country, should not be seen or heard making comments that will reduce him to a sycophant. Wike, who spoke at the Special Thanksgiving Service organized by Speaker of the Rivers State House of Assembly, Hon. Martin Chike Amaewhule, at the Church of Nigeria (Anglican Communion), Oro-Igwe/Eliogbolo Archdeaconry Church of the Holy Spirit, Eliozu Parish, Port Harcourt on Sunday, said it was unfortunate that somebody who is supposed to be seen as an elder statesman and called a father can reduce himself to a sycophant and a trader. According to a statement signed by Lere Olayinka, the Minister’s Senior Special Assistant to the FCT Minister (Public Communications and New Media), the Minister said, “Must you be a trader all the time? As governor for eight years, what else are you looking for?” “You know, I didn’t want to say anything. But somebody called me last night and told me what someone said on social media. I said until I read it myself. This morning, I read in the newspapers, what our former Governor, Sir Dr Peter Odili said. “What did he say? He said that the present governor has been able to stop one man who wanted to convert Rivers State to his personal estate. “Between him and myself, who has turned Rivers State into his personal estate? His wife is a Chairman of the Governing Council, his daughter is a commissioner, his other daughter is a judge and he is the general overseer. “Who has now turned Rivers State to his private estate? I am sure if care is not taken if there is a chance, he can even arrange a marriage for the governor. “It was his nephew, his late senior brother’s son that was recommended for commissioner. He took the slot and gave it to his own daughter. Someone who didn’t remember to stand for the son of his late elder brother, is that an elder statesman?” Speaking further, the FCT Minister said it was painful that Dr Odili, out of political sycophancy, has forgotten all that he said in the past, adding; “All of you here remember when I was governor, this same Odili praised me to high heaven. In fact, he said then that all past governors in Rivers State combined did not do better than me. “In 2007 after he left office, he couldn’t come near power in the State because Amaechi was the governor then, he was gone! “Like somebody said that God will use someone to lift up someone. When I came in as governor in 2015, I won’t use the word resurrected, but I brought him back to life. “All of us know about PAMO University. But for us, there wouldn’t have been anything called PAMO University. Rivers State was sponsoring 100 students per session and for every semester, each of the students was paying nothing less than N5m. Then, Rivers people were attacking me up and down”, he added.
The Prime Minister insisted the UK will back Ukraine “for as long as it takes” as he made a speech at the Lord Mayor’s Banquet in London, but for the first time acknowledged the conflict could move towards a negotiated end. Ukrainian President Volodymyr Zelensky has in recent weeks suggested he is open to a possible ceasefire with Vladimir Putin’s Russia. Kyiv and its European allies meanwhile fear the advent of Donald Trump’s return to the White House could result in American aid being halted. President-elect Trump has said he would prefer to move towards a peace deal, and has claimed he could end the conflict on “day one” of his time in power. As he attempts to strike up a good relationship with the incoming president, Sir Keir revealed he had told Mr Trump the UK “will invest more deeply than ever in this transatlantic bond with our American friends in the years to come”. In his speech at London’s Guildhall, the Prime Minister said there is “no question it is right we support Ukraine”, as the UK’s aid to Kyiv is “deeply in our self-interest”. Allowing Russia to win the war would mean “other autocrats would believe they can follow Putin’s example,” he warned. Sir Keir added: “So we must continue to back Ukraine and do what it takes to support their self-defence for as long as it takes. “To put Ukraine in the strongest possible position for negotiations so they can secure a just and lasting peace on their terms that guarantees their security, independence, and right to choose their own future.” Mr Zelensky told Sky News over the weekend he would be open to speaking with Mr Putin, but branded the Russian president a “terrorist”. He also suggested Ukrainian territory under his control should be taken under the “Nato umbrella” to try to stop the “hot stage” of the war with Russia. In a banquet speech focused on foreign affairs, the Prime Minister said it was “plain wrong” to suggest the UK must choose between its allies, adding: “I reject it utterly. “(Clement) Attlee did not choose between allies. (Winston) Churchill did not choose. “The national interest demands that we work with both.” Sir Keir said the UK and the US were “intertwined” when it came to commerce, technology and security. The Prime Minister added: “That’s why, when President Trump graciously hosted me for dinner in Trump Tower, I told him that we will invest more deeply than ever in this transatlantic bond with our American friends in the years to come.” He also repeated his commitment to “rebuild our ties with Europe” and insisted he was right to try to build closer links with China. “It is remarkable that until I met President Xi last month there had been no face-to-face meeting between British and Chinese leaders for six years,” the Prime Minister said. “We can’t simply look the other way. We need to engage. To co-operate, to compete and to challenge on growth, on security concerns, on climate as well as addressing our differences in a full and frank way on issues like Hong Kong, human rights, and sanctions on our parliamentarians,” he added. The Prime Minister said he wants Britain’s role in the world to be that of “a constant and responsible actor in turbulent times”. He added: “To be the soundest ally and to be determined, always, in everything we do. “Every exchange we have with other nations, every agreement we enter into to deliver for the British people and show, beyond doubt, that Britain is back.” Ahead of Sir Keir’s speech, Lord Mayor Alastair King urged the Prime Minister and his Government to loosen regulations on the City of London to help it maintain its competitive edge. In an echo of Sir Keir’s commitment to drive the UK’s economic growth, the Lord Mayor said: “The idealist will dream of growth, but the pragmatist understands that our most effective machinery to drive growth is here in the City, in the hands of some of the brightest and most committed people that you will find anywhere in the world.”China's getting a big electric car battery swapping boost in 2025. Rodgers says he's undecided about playing next season, but Jets are his 'first option' if he returns Aaron Rodgers is still contemplating whether he wants to play football next season. And if he does return, he said during his weekly appearance on “The Pat McAfee Show” on Tuesday that he prefers it to be with the New York Jets. The star quarterback, who turns 41 next Monday, denied a recent report that he wants to keep playing next year but not with the Jets. He said he needs to see how he feels physically and where the Jets stand with a new general manager and coach. He added that the Jets will also have to want him playing for them. That will all factor into his decision. Court rejects request to sideline San Jose State volleyball player on grounds she’s transgender A federal appeals court has upheld a ruling that allows a San Jose State women’s volleyball team member to play in the Mountain West Conference tournament after complaints said she should be ineligible on grounds that she’s transgender. The 10th U.S. Circuit Court of Appeals ruled Tuesday that a U.S. Magistrate in Denver was correct in allowing her to play. The magistrate and the appeals court said the players and others who sued should have filed their complaint earlier, rather than waiting until less than two weeks before the tournament was to begin to seek an emergency injunction. Traffic citations against Dolphins' Tyreek Hill dismissed after officers no-show at hearing MIAMI (AP) — Traffic citations issued to Miami Dolphins star wide receiver Tyreek Hill after a September altercation with police have been dismissed after the charging officers didn’t attend a court hearing. Hill’s tickets for careless driving and failing to wear a seat belt were dismissed after the Miami-Dade Police officers failed to show up for a Monday hearing. The tickets were issued after Hill was stopped outside Hard Rock Stadium for allegedly speeding before the Dolphins' season opener on Sept. 8. The stop escalated and an officer pulled Hill from the car, forced him to the ground and handcuffed him. North Carolina football coach Mack Brown won't return for 2025 season North Carolina coach Mack Brown won’t return for the 2025 season. The school announced the move Tuesday with a statement from athletic director Bubba Cunningham. The school said Cunningham informed the 73-year-old College Football Hall of Fame member that there would be a coaching change. The former Barcelona and Argentina teammates have reunited, with Inter Miami announcing Tuesday that Mascherano’s hiring as the club’s new coach is complete. The sides struck a deal late last week for Mascherano to replace Gerardo “Tata” Martino, who stepped aside for personal reasons. Mascherano most recently was Argentina’s under-20 team coach. Mascherano says he was “drawn to the organization’s undeniable ambition." Will Utah State or Boise State forfeit vs. San Jose State in the Mountain West semifinals? LAS VEGAS (AP) — A team that previously boycotted at least one match against the San Jose State women’s volleyball team will be faced with another decision whether to play the school, this time in the Mountain West Conference semifinals with a shot at the NCAA Tournament on the line. Five schools forfeited matches in the regular season against San Jose State, which carried a No. 2 seed into the conference tournament in Las Vegas. Among those schools: No. 3 Utah State and No. 6 Boise State, who will face off Wednesday with the winner scheduled to play the Spartans in the semifinals on Friday. NBA says Hawks violated player participation policy by sitting Trae Young for Cup game The NBA fined the Atlanta Hawks $100,000 after an investigation determined that guard Trae Young could have played in an NBA Cup game against the Boston Celtics on Nov. 12. The Hawks listed Young on their injury report that night as out because of tendinitis in his right Achilles. Atlanta wound up winning the game anyway, 117-116. The issue, the NBA said, was that the Hawks were in violation of the league’s player participation policy — which focuses primarily on what the league defines as star players, a group that Young would qualify for since he was an All-Star selection last season. Texas and Texas A&M reunite Saturday in SEC after bitter breakup tore apart a football tradition COLLEGE STATION, Texas (AP) — Texas and Texas A&M first met Texas on the football field in 1894 in a rivalry that would cut across the state and through families for generations. It would not last. In 2011, Texas A&M announced it was leaving Texas and the Big 12 behind to join the Southeastern Conference, determined to focus only on a bright future, not dwell on a sentimental past. Bitter finger pointing and hard feelings eventually gave way to shrugs of indifference and mutters of “good riddance." Then Texas joined the SEC this season. The No. 3 Longhorns and No. 20 Aggies finally meet again Saturday night in College Station with a berth in the SEC championship game on the line. Oklahoma's throwback offensive approach against Alabama gets LSU's attention NORMAN, Okla. (AP) — Oklahoma appears to have borrowed from the past to cure its recent offensive ills. AP collegebasketball: https://apnews.com/hub/ap-top-25-college-basketball-poll and https://apnews.com/hub/college-basketballWASHINGTON (AP) — One year after the Jan. 6, 2021 , U.S. Capitol attack, Attorney General Merrick Garland said the Justice Department was committed to holding accountable all perpetrators “at any level” for “the assault on our democracy.” That bold declaration won't apply to at least one person: Donald Trump. Special counsel Jack Smith's move on Monday to abandon the federal election interference case against Trump means jurors will likely never decide whether the president-elect is criminally responsible for his attempts to cling to power after losing the 2020 campaign. The decision to walk away from the election charges and the separate classified documents case against Trump marks an abrupt end of the Justice Department’s unprecedented legal effort that once threatened his liberty but appears only to have galvanized his supporters. The abandonment of the cases accusing Trump of endangering American democracy and national security does away with the most serious legal threats he was facing as he returns to the White House. It was the culmination of a monthslong defense effort to delay the proceedings at every step and use the criminal allegations to Trump's political advantage, putting the final word in the hands of voters instead of jurors. “We always knew that the rich and powerful had an advantage, but I don’t think we would have ever believed that somebody could walk away from everything,” said Stephen Saltzburg, a George Washington University law professor and former Justice Department official. “If there ever was a Teflon defendant, that’s Donald Trump.” While prosecutors left the door open to the possibility that federal charges could be re-filed against Trump after he leaves office, that seems unlikely. Meanwhile, Trump's presidential victory has thrown into question the future of the two state criminal cases against him in New York and Georgia. Trump was supposed to be sentenced on Tuesday after his conviction on 34 felony counts in his New York hush money case , but it's possible the sentencing could be delayed until after Trump leaves office, and the defense is pushing to dismiss the case altogether. Smith's team stressed that their decision to abandon the federal cases was not a reflection of the merit of the charges, but an acknowledgement that they could not move forward under longstanding Justice Department policy that says sitting presidents cannot face criminal prosecution. Trump's presidential victory set “at odds two fundamental and compelling national interests: On the one hand, the Constitution’s requirement that the President must not be unduly encumbered in fulfilling his weighty responsibilities . . . and on the other hand, the Nation’s commitment to the rule of law,” prosecutors wrote in court papers. The move just weeks after Trump's victory over Vice President Kamala Harris underscores the immense personal stake Trump had in the campaign in which he turned his legal woes into a political rallying cry. Trump accused prosecutors of bringing the charges in a bid to keep him out of the White House, and he promised revenge on his perceived enemies if he won a second term. “If Donald J. Trump had lost an election, he may very well have spent the rest of his life in prison,” Vice President-elect JD Vance, wrote in a social media post on Monday. “These prosecutions were always political. Now it’s time to ensure what happened to President Trump never happens in this country again.” After the Jan. 6 attack by Trump supporters that left more than 100 police officers injured, Republican leader Mitch McConnell and several other Republicans who voted to acquit Trump during his Senate impeachment trial said it was up to the justice system to hold Trump accountable. The Jan. 6 case brought last year in Washington alleged an increasingly desperate criminal conspiracy to subvert the will of voters after Trump's 2020 loss, accusing Trump of using the angry mob of supporters that attacked the Capitol as “a tool” in his campaign to pressure then-Vice President Mike Pence and obstruct the certification of Democrat Joe Biden's victory. Hundreds of Jan. 6 rioters — many of whom have said they felt called to Washington by Trump — have pleaded guilty or been convicted by juries of federal charges at the same courthouse where Trump was supposed to stand trial last year. As the trial date neared, officials at the courthouse that sits within view of the Capitol were busy making plans for the crush of reporters expected to cover the historic case. But Trump's argument that he enjoyed absolute immunity from prosecution quickly tied up the case in appeals all the way up to the Supreme Court. The high court ruled in July that former presidents have broad immunity from prosecution , and sent the case back to the trial court to decide which allegations could move forward. But the case was dismissed before the trial court could got a chance to do so. The other indictment brought in Florida accused Trump of improperly storing at his Mar-a-Lago estate sensitive documents on nuclear capabilities, enlisting aides and lawyers to help him hide records demanded by investigators and cavalierly showing off a Pentagon “plan of attack” and classified map. But U.S. District Judge Aileen Cannon dismissed the case in July it on grounds that Smith was illegally appointed . Smith appealed to the Atlanta-based 11th U.S. Circuit Court of Appeals, but abandoned that appeal on Monday. Smith's team said it would continue its fight in the appeals court to revive charges against Trump's two co-defendants because “no principle of temporary immunity applies to them.” In New York, jurors spent weeks last spring hearing evidence in a state case alleging a Trump scheme to illegally influence the 2016 election through a hush money payment to a porn actor who said the two had sex. New York prosecutors recently expressed openness to delaying sentencing until after Trump's second term, while Trump's lawyers are fighting to have the conviction dismissed altogether. In Georgia, a trial while Trump is in office seems unlikely in a state case charging him and more than a dozen others with conspiring to overturn his 2020 election loss in the state. The case has been on hold since an appeals court agreed to review whether to remove Fulton County District Attorney Fani Willis over her romantic relationship with the special prosecutor she had hired to lead the case.
