Jimmy Carter, the 39th US president, has died at 100Washington: Jimmy Carter, the earnest Georgia peanut farmer who as US president struggled with a bad economy and the Iran hostage crisis but brokered peace between Israel and Egypt and later received the Nobel Peace Prize for his humanitarian work, died at his home in Plains, Georgia, on Sunday, the Carter Centre said. Carter was swept from office four years later in an electoral landslide as voters embraced Republican challenger Ronald Reagan, the former actor and California governor. Carter lived longer after his term in office than any other US president. Along the way, he earned a reputation as a better former president than he was a president - a status he readily acknowledged. His one-term presidency was marked by the highs of the 1978 Camp David accords between Israel and Egypt, bringing some stability to the Middle East. But it was dogged by an economy in recession, persistent unpopularity and the embarrassment of the Iran hostage crisis that consumed his final 444 days in office. Carter decided to receive hospice care in February 2023 instead of undergoing additional medical intervention. His wife, Rosalynn Carter, died on November 19, 2023, at age 96. He looked frail when he attended her memorial service and funeral in a wheelchair. Carter left office profoundly unpopular but worked energetically for decades on humanitarian causes. He was awarded the Nobel Peace Prize in 2002 in recognition of his “untiring effort to find peaceful solutions to international conflicts, to advance democracy and human rights, and to promote economic and social development.” Carter had been a centrist as governor of Georgia with populist tendencies when he moved into the White House as the 39th US president. He was a Washington outsider at a time when America was still reeling from the Watergate scandal that led Republican Richard Nixon to resign as president in 1974 and elevated Ford from vice president.

Aam Aadmi Party (AAP) national convener Arvind Kejriwal on Wednesday targeted Union Minister Amit Shah over Delhi’s law-and-order situation, alleging that the city has turned into a “crime and extortion capital” under his watch. Mr. Kejriwal — a former Delhi Chief Minister — made the remarks at the Nangloi Jat Assembly segment where he had gone to meet a trader outside whose shop firing was reported on September 28 this year. “Daylight shootings and extortion cases have become common. We had never thought that Delhi would see such days. Unfortunately, Delhi has fallen into the hands of gangsters, with businessmen receiving extortion calls over their phones,” said Mr. Kejriwal attacking the Union Minister under whom Delhi Police comes. Forthright and fearless, the Nobel Prize winner took pot-shots at former prime minister Tony Blair and ex-US president George W Bush among others. His death came after repeated bouts of illness in which images of the increasingly frail former president failed to erase memories of his fierce spirit. Democrat James Earl “Jimmy” Carter Jr swept to power in 1977 with his Trust Me campaign helping to beat Republican president Gerald Ford. Serving as 39th US president from 1977 to 1981, he sought to make government “competent and compassionate” but was ousted by the unstoppable Hollywood appeal of a certain Ronald Reagan. A skilled sportsman, Mr Carter left his home of Plains, Georgia, to join the US Navy, returning later to run his family’s peanut business. A stint in the Georgia senate lit the touchpaper on his political career and he rose to the top of the Democratic movement. But he will also be remembered for a bizarre encounter with a deeply disgruntled opponent. The president was enjoying a relaxing fishing trip near his home town in 1979 when his craft was attacked by a furious swamp rabbit which reportedly swam up to the boat hissing wildly. The press had a field day, with one paper bearing the headline President Attacked By Rabbit. Away from encounters with belligerent bunnies, Mr Carter’s willingness to address politically uncomfortable topics did not diminish with age. He recently said that he would be willing to travel to North Korea for peace talks on behalf of US President Donald Trump. He also famously mounted a ferocious and personal attack on Tony Blair over the Iraq war, weeks before the prime minister left office in June 2007. Mr Carter, who had already denounced George W Bush’s presidency as “the worst in history”, used an interview on BBC radio to condemn Mr Blair for his tight relations with Mr Bush, particularly concerning the Iraq War. Asked how he would characterise Mr Blair’s relationship with Mr Bush, Mr Carter replied: “Abominable. Loyal, blind, apparently subservient. “I think that the almost undeviating support by Great Britain for the ill-advised policies of President Bush in Iraq have been a major tragedy for the world.” Mr Carter was also voluble over the Rhodesia crisis, which was about to end during his presidency. His support for Robert Mugabe at the time generated widespread criticism. He was said to have ignored the warnings of many prominent Zimbabweans, black and white, about what sort of leader Mugabe would be. This was seen by Mr Carter’s critics as “deserving a prominent place among the outrages of the Carter years”. Mr Carter has since said he and his administration had spent more effort and worry on Rhodesia than on the Middle East. He admitted he had supported two revolutionaries in Mugabe and Joshua Nkomo, and with hindsight said later that Mugabe had been “a good leader gone bad”, having at first been “a very enlightened president”. One US commentator wrote: “History will not look kindly on those in the West who insisted on bringing the avowed Marxist Mugabe into the government. “In particular, the Jimmy Carter foreign policy... bears some responsibility for the fate of a small African country with scant connection to American national interests.” In recent years Mr Carter developed a reputation as an international peace negotiator. He won the Nobel Peace Prize in 2002 for his commitment to finding peaceful solutions to international conflicts, his work with human rights and democracy initiatives, and his promotion of economic and social programmes. Mr Carter was dispatched to North Korea in August 2008 to secure the release of US citizen Aijalon Mahli Gomes, who had been sentenced to eight years of hard labour after being found guilty of illegally entering North Korea. He successfully secured the release of Mr Gomes. In 2010 he returned to the White House to greet President Barack Obama and discuss international affairs amid rising tensions on the Korean peninsula. Proving politics runs in the family, in 2013 his grandson Jason, a state senator, announced his bid to become governor in Georgia, where his famous grandfather governed before becoming president. He eventually lost to incumbent Republican Nathan Deal. Fears that Mr Carter’s health was deteriorating were sparked in 2015 when he cut short an election observation visit in Guyana because he was “not feeling well”. It would have been Mr Carter’s 39th trip to personally observe an international election. Three months later, on August 12, he revealed he had cancer which had been diagnosed after he underwent surgery to remove a small mass in his liver. Mr Obama was among the well-wishers hoping for Mr Carter’s full recovery after it was confirmed the cancer had spread widely. Melanoma had been found in his brain and liver, and Mr Carter underwent immunotherapy and radiation therapy, before announcing in March the following year that he no longer needed any treatment. In 2017, Mr Carter was taken to hospital as a precaution, after he became dehydrated at a home-building project in Canada. He was admitted to hospital on multiple occasions in 2019 having had a series of falls, suffering a brain bleed and a broken pelvis, as well as a stint to be treated for a urinary tract infection. Mr Carter spent much of the coronavirus pandemic largely at his home in Georgia, and did not attend Joe Biden’s presidential inauguration in 2021, but extended his “best wishes”. Former first lady Rosalynn Carter, the closest adviser to Mr Carter during his term as US president, died in November 2023. She had been living with dementia and suffering many months of declining health. “Rosalynn was my equal partner in everything I ever accomplished,” Mr Carter said in a statement following her death. “She gave me wise guidance and encouragement when I needed it. As long as Rosalynn was in the world, I always knew somebody loved and supported me.”Bank frauds increased to 18,461, amount involved spikes 8x in H1FY25: RBI NEW DELHI: In the first half of the current fiscal, the number of bank frauds witnessed a significant on-year increase to 18,461 cases. The amount involved in these frauds also jumped more than eight-fold to Rs 21,367 crore, RBI data said. In its report on Trend and Progress of Banking in India 2023-24, RBI presented the performance of the banking sector, including commercial banks, co-operative banks and non-banking financial institutions, during 2023-24 and 2024-25 so far. The number of frauds during April-September stood at 18,461 involving Rs 21,367 crore compared to 14,480 cases involving Rs 2,623 crore in the comparative period of the last financial year, based on the date of fraud reporting. The RBI report said frauds present multiple challenges for the financial system in the form of reputational risk, operational risk, business risk and erosion of customer confidence with financial stability implications. The share of internet and card frauds in the total stood at 44.7% in terms of amount and 85.3% in terms of number of cases. In 2023-24, the number of fraud cases reported by private sector banks (PVBs) accounted for 67.1% of the total. In terms of amount involved, however, public sector banks (PSBs) had the highest share of card and internet frauds was highest for all bank groups in 2023-24. The RBI data said the instances of penalty imposed on regulated entities (REs) increased during 2023- 24 across all bank groups, except foreign banks and small finance banks. The total penalty amount more than doubled in 2023-24 to Rs 86.1 crore, led by public and private sector banks. The amount of penalty imposed on co-operative banks declined during the year, while there was an increase in instances of penalty imposition. While many cases of digital fraud result from social engineering attacks on customers, there is also a rapid increase in the use of mule bank accounts to perpetrate such frauds, RBI said. “This exposes banks not only to serious financial and operational risks, but also to reputational risks. Banks, therefore, need to strengthen their customer onboarding and transaction monitoring systems to monitor unscrupulous activities,” it added. Agencies

TO all The Legal Mind readers, thank you so much for another year of following this column, exclusively devoted to my education advocacy as a lawyer. And I extend my profound gratitude to the Times for once again giving me this space to connect with our education stakeholders and talk about legal issues on education. Through this column, I was able to answer queries and feature them here for others to learn from. Our discussions on complex education laws and policies have been cited even by policymakers in continuing discussions on education reforms. I also received personal messages of gratitude from administrators who turn to our discussions here to supplement their knowledge in performing their functions in the school. Thank you most especially to all our teachers, both from public and private schools, who continue to follow The Legal Mind. I remember a public school teacher who asked permission to share to her students one of my articles entitled, "The role of parents in the education of their children," for their small group discussion relevant to their MELC, or most essential learning competencies. I will continue with my education advocacy for 2025 even as I juggle other areas of practice at the Estrada & Aquino Law, as its managing partner. I will now be full-time in my private practice at the firm after my stint as chief legal officer of the Second Congressional Commission on Education (EdCom 2) from January 2023 to September 2024. As a lawyer of educational institutions and associations, I will still be around for congressional deliberations on education bills as I have been doing for almost 20 years, helping craft measures to improve the quality of education and the promotion of welfare of learners, teachers and educational institutions. I will also continue going around the country for learning sessions with schools. This is something I look forward to doing every week for the rest of the year, as I get to learn a lot from the sharing of teachers, school personnel, students and even parents as well. I can't wait for January to start my speaking engagements, beginning with Laguna, Cagayan de Oro and Pampanga for the first month of 2025. School communities should prepare for at least three emerging issues to update their school policies: administrative and ethical impact of artificial intelligence in schools, schools as safe spaces for students — on protective measures against sexual harassment, bullying and cyber offenses, and gender inclusivity and neutrality — on cross-dressing, haircuts, self-expression and similar issues. Many educational institutions still need to address the recurring issues on the impact of social media and digital technology on their learners and educators, as well as the evolving capacities of minors in navigating these platforms. Moreover, the urgency to acknowledge in school policy environments the teenage psychology and predisposition of this generation of minor students, particularly their attitude toward sex, cannot be overemphasized. In my continuous interaction with schools as counsel, I have observed that there is an alarming prevalence of sex-related misconduct for child learners in schools. Thus, there is a need to recalibrate school interventions and discipline policies to conform with the profile of minor students at this day and age. Fortunately, Republic Act 12080, or the Basic Education Mental Health and Well-being Promotion Act, was recently enacted into law. This landmark measure aimed at strengthening mental health programs in schools and creating new plantilla positions for guidance counselors will certainly help in addressing these emerging issues surrounding schools and students. For 2025, I also expect the updating of major administrative issuances of the Commission on Higher Education, Department of Education (DepEd), and the Technical Education and Skills Development Authority (Tesda). DepEd has been reviewing and drafting the revisions to its Manual of Regulations for several years through the change of administrations; and with Education Secretary Sonny Angara now at the helm, I expect that the revision of the manual will finally see the light of day. The Commission on Higher Education, with new commissioners joining the agency governing higher education, would also be introducing reforms in higher education to keep up with global trends and practices, and also with the final recommendations from EdCom 2 coming out this year. Tesda will be introducing more reforms as it continues to rebrand the authority and recalibrate its important role in the trifocalized education sector under the leadership of Secretary Kiko Benitez, most especially with the recent enactment of Republic Act 12063, or the Enterprise-based Education and Training Framework Act, aiming to provide Filipino workers with opportunities to gain new skills and competencies or to upskill for career advancement so they could secure quality jobs or obtain entrepreneurial proficiency. This landmark legislation's implementation falls primarily on the mandate of Tesda. The education sector, particularly the private sector, can count on me this coming year to continue advocating for the promotion of quality education, protection of learners, and in moving the guideposts in the education policy landscape to create more spaces for innovation. Wearable technology — smartwatches, smart rings, fitness trackers and the like — monitors body-centric data such as your heart rate, steps taken and calories burned, and may record where you go along the way. Like Santa Claus, it knows when you are sleeping (and how well), it knows when you’re awake, it knows when you’ve been idle or exercising, and it keeps track of all of it. People are also sharing sensitive health information on , including online mental health and counseling programs. Some women use period tracker apps to map out their monthly cycle. These devices and services have excited consumers hoping for better insight into their health and lifestyle choices. But the lack of oversight into how body-centric data are used and shared with third parties has prompted concerns from privacy experts, who warn that the data could be sold or lost through data breaches, then used to raise insurance premiums, discriminate surreptitiously against applicants for jobs or housing, and even perform surveillance. The use of wearable technology and medical apps surged in the years following the COVID-19 pandemic, but indicates that current laws offer little protection for consumers who are often unaware just how much of their health data are being collected and shared by companies. “I’ve been studying the intersections of emerging technologies, data-driven technologies, AI and human rights and social justice for the past 15 years, and since the pandemic I’ve noticed the industry has become hyper-focused on our bodies,” said Mozilla Foundation technology fellow Júlia Keserű, who conducted the research. “That permeates into all kinds of areas of our lives and all kinds of domains within the tech industry.” The report “From Skin to Screen: Bodily Integrity in the Digital Age” recommends that existing data protection laws be clarified to encompass all forms of bodily data. It also calls for expanding national health privacy laws to cover health-related information collected from health apps and fitness trackers and making it easier for users to opt out of body-centric data collections. Researchers have been raising alarms about health data privacy for years. Data collected by companies are often sold to data brokers or groups that buy, sell and trade data from the internet to create detailed consumer profiles. Body-centric data can include information such as the fingerprints used to unlock phones, face scans from facial recognition technology, and data from fitness and fertility trackers, mental health apps and digital medical records. One of the key reasons health information has value to companies — even when the person’s name is not associated with it — is that advertisers can use the data to send targeted ads to groups of people based on certain details they share. The information contained in these consumer profiles is becoming so detailed, however, that when paired with other data sets that include location information, it could be possible to target specific individuals, Keserű said. Location data can “expose sophisticated insights about people’s health status, through their visits to places like hospitals or abortions clinics,” Mozilla’s report said, adding that “companies like Google have been reported to keep such data even after promising to delete it.” revealed that data brokers were selling sensitive data on individuals’ mental health conditions on the open market. While many brokers deleted personal identifiers, some provided names and addresses of individuals seeking mental health assistance, according to the report. In two public surveys conducted as part of the research, Keserű said, participants were outraged and felt exploited in scenarios where their health data were sold for a profit without their knowledge. “We need a new approach to our digital interactions that recognizes the fundamental rights of individuals to safeguard their bodily data, an issue that speaks directly to human autonomy and dignity,” Keserű said. “As technology continues to advance, it is critical that our laws and practices evolve to meet the unique challenges of this era.” Consumers often take part in these technologies without fully understanding the implications. Last month, that users submit X-rays, PET scans, MRIs and other medical images to Grok, the platform’s artificial intelligence chatbot, to seek diagnoses. The issue alarmed privacy experts, but many X users heeded Musk’s call and submitted health information to the chatbot. While X’s privacy policy says that the company will not sell user data to third parties, it does share some information with certain business partners. Gaps in existing laws have allowed the widespread sharing of biometric and other body-related data. Health information provided to hospitals, doctor’s offices and medical insurance companies is protected from disclosure under the , known as HIPAA, which established federal standards protecting such information from release without the patient’s consent. But health data collected by many wearable devices and health and wellness apps don’t fall under HIPAA’s umbrella, said Suzanne Bernstein, counsel at Electronic Privacy Information Center. “In the U.S. because we don’t have a comprehensive federal privacy law ... it falls to the state level,” she said. But not every state has weighed in on the issue. Washington, Nevada and Connecticut all recently passed laws to provide safeguards for consumer health data. that aimed to require tech companies to adhere to strengthened privacy provisions regarding the collection, sharing, use or sale of consumer health data. In California, the California Privacy Rights Act regulates how businesses can use certain types of sensitive information, including biometric information, and requires them to offer consumers the ability to opt out of disclosure of sensitive personal information. “This information being sold or shared with data brokers and other entities hypercharge the online profiling that we’re so used to at this point, and the more sensitive the data, the more sophisticated the profiling can be,” Bernstein said. “A lot of the sharing or selling with third parties is outside the scope of what a consumer would reasonably expect.” Health information has become a prime target for hackers seeking to extort healthcare agencies and individuals after accessing sensitive patient data. Health-related cybersecurity breaches and ransom attacks increased more than 4,000% between 2009 and 2023, targeting the booming market of body-centric data, which is expected to exceed $500 billion by 2030, according to the report. “Nonconsensual data sharing is a big issue,” Keserű said. “Even if it’s biometric data or health data, a lot of the companies are just sharing that data without you knowing, and that is causing a lot of anxiety and questions.”

This rally also marked the second-highest single-day increase in market capitalisation, surging by an impressive Rs526 billion. The bullish momentum, driven by a cooling political climate in Islamabad, pushed the index to a new milestone, closing above the 99,000 mark for the first time. Market analysts are abuzz with optimism, predicting the index is on the cusp of breaching the coveted six-figure threshold. The Pakistan Stock Exchange’s (PSX) benchmark KSE 100 Index surged by a record 4,695.09 points or 4.96 per cent to 99,269.25 points against 94,574.16 points recorded in the last session. The highest index of the day remained at 99,549.81 points while the lowest level was recorded at 97,188.28 points. Analyst Maaz Mulla at Topline Securities said the bulls staged a remarkable recovery as the KSE-100 Index soared to an intraday high of 4,975 points, recording the largest single-day gain in its history. This impressive rally followed yesterday’s sharp downturn, with the index closing at 99,269 -- up by 4,695 points or 4.96 per cent. “The market’s positive sentiment was largely driven by the opposition party’s decision to end its protest in the capital city [in the early hours of Wednesday],” he said. This shift marked a complete reversal from Tuesday’s turmoil, where the benchmark KSE-100 Index experienced its biggest single-day drop. In an extraordinary recovery, the market rebounded, fully offsetting and surpassing the previous session’s losses. In terms of market capitalisation, Tuesday’s decline of Rs480 billion was followed by an exceptional increase of Rs526 billion Wednesday, marking the second-highest single-day surge in history. The trading floor witnessed robust buying activity, with the index-heavy banking sector leading the charge. Other significant contributors included automobile assemblers, oil and gas exploration companies, oil marketing companies (OMCs) and power generation firms. Top contributors to the index’s upward trajectory were FFC, HBL, SYS, BAHL, and PPL, collectively adding 1,546 points. The KSE-30 index increased by 1,587.57 points or 5.39 per cent to 31,032.39 points against 29,444.82 points. Traded shares decreased by 59 million shares to 1,057.104 million shares from 1,116.324 million shares. The trading value dropped to Rs39.556 billion from Rs43.291 billion. Market capital expanded to Rs12.577 trillion against Rs12.052 trillion. Of the 453 companies active in the session, 356 closed in green, 52 in red and 45 remained unchanged. Ahsan Mehanti, an analyst at Arif Habib Corp, said, “Stocks closed to a new all-time high led by scrips across the board after the PTI ended protests in the capital, easing political noise and concerns for security unrest.” He said that upbeat economic indicators, speculations over likely lower CPI inflation for November and rupee stability played a catalyst role in the bullish activity. The highest increase was recorded in Unilever Pakistan Foods Limited, which rose by Rs348.78 to Rs19,368.13 per share, followed by Rafhan Maize Products Company Limited, which increased by Rs175.27 to Rs7,988.75 per share. A significant decline was noted in Pakistan Services Limited, which fell by Rs50.29 to Rs827.72 per share; Sapphire Textile Mills Limited followed it, which closed lower by Rs26.35 to Rs1,151.64 per share. Analyst Mubashir Anis Naviwala at JS Global said the PSX rebounded strongly, recovering sharply from Tuesday’s panic-driven selloff. “Investor activity picked up significantly, fuelled by easing political tensions, with robust gains seen across the board,” he said. “Renewed investor optimism, supported by improving macroeconomic indicators and declining fixed-income yields, signals a sustained bullish outlook for the equity market.” BO Punjab remained the volume leader with 114.966 million shares which closed higher by Re1 to Rs7.85 per share. Hascol Petrol followed it with 106.286 million shares, which closed lower by Re1 to Rs12.59 per share. Other significant turnover stocks included K-Electric Ltd, Fauji Foods Ltd, Bank Makramah, Pace (Pak) Ltd, Sui South Gas, Cnergyico PK, WorldCall Telecom and National Bank XD. In the futures market, 307 companies recorded trading, 291 of which increased, 15 decreased, and one remained unchanged.
