U.S. prosecutors moved on Monday to drop the two federal criminal cases against Donald Trump involving his efforts to overturn his 2020 election defeat and his handling of classified documents, citing Justice Department policy against prosecuting a sitting president. The steps by prosecutors working with Special Counsel Jack Smith in the two cases represent a big legal victory for the Republican president-elect, who won the Nov. 5 U.S. election and is set to return to office on Jan. 20. The Justice Department policy that the prosecutors cited dates back to the 1970s. It holds that a criminal prosecution of a sitting president would violate the U.S. Constitution by undermining the ability of the country's chief executive to function. Courts will still have to approve both requests from prosecutors. The prosecutors in a filing in the election subversion case said the department's policy requires the case to be dismissed before Trump returns to the White House. "This outcome is not based on the merits or strength of the case against the defendant," prosecutors wrote in the filing. Smith's office similarly moved to end its attempt to revive the case accusing Trump of illegally retaining classified documents when he left office in 2021 after his first term as president. But the prosecutors signaled they will still ask a federal appeals court to bring back the case against two Trump associates who had been accused of obstructing that investigation. Trump spokesman Steven Cheung hailed what he called "a major victory for the rule of law." Trump had faced criminal charges in four cases -- the two brought by Smith and two in state courts in New York and Georgia. He was convicted in the New York case while the Georgia case is in limbo. In a post on social media, Trump railed on Monday against the legal cases as a "low point in the History of our Country." The moves by Smith, who was appointed in 2022 by U.S. Attorney General Merrick Garland, represents a remarkable shift from the special prosecutor who obtained indictments against Trump in two separate cases accusing him of crimes that threatened U.S. election integrity and national security. Prosecutors acknowledged that the election of a president who faced ongoing criminal cases created an unprecedented predicament for the Justice Department. It shows how Trump's election victory over Democratic Vice President Kamala Harris was not just a political triumph, but also a legal one. Trump pleaded not guilty in August 2023 to four federal charges accusing him of conspiring to obstruct the collection and certification of votes following his 2020 loss to Democrat Joe Biden. Trump, who as president will again oversee the Justice Department, was expected to order an end to the federal 2020 election case and to Smith's appeal in the documents case. Florida-based Judge Aileen Cannon, who Trump appointed to the federal bench, had dismissed the classified documents case in July, ruling that Smith was improperly appointed to his role as special counsel. Smith's office had been appealing that ruling and indicated on Monday that the appeal would continue as it relates to Trump personal aide Walt Nauta and Carlos De Oliveira, a manager at his Mar-a-Lago resort, who had been previously charged alongside Trump in the case. Both Nauta and De Oliveria have pleaded not guilty, as did Trump. In the 2020 election case, Trump's lawyers had previously said they would seek to dismiss the charges based on a U.S. Supreme Court ruling in July that former presidents have broad immunity from prosecution over official actions taken while in the White House. Smith attempted to salvage the case following that ruling, dropping some allegations but arguing that the rest were not covered by presidential immunity and could proceed to trial. Judge Tanya Chutkan had been due to decide whether the immunity decision required other portions of the case to be thrown out. A trial date originally set for March 2024 had not been rescheduled. The case was brought following an investigation led by Smith into Trump's attempts to retain power following his 2020 election defeat, culminating in the Jan. 6, 2021, attack on the U.S. Capitol by a mob of his supporters following his inflammatory speech near the White House. Trump denied wrongdoing and argued that the U.S. legal system had been turned against him to damage his presidential campaign. He vowed during the campaign that he would fire Smith if he returned to the presidency. Trump in May became the first former president to be convicted of a crime when a jury in New York found him guilty of felony charges relating to hush money paid to a porn star before the 2016 election. His sentencing in that case has been indefinitely postponed. The criminal case against Trump in Georgia state court involving the 2020 election is stalled.

DAILY POST reports that PDP on Thursday alleged that a member of APC mobilised some youths to invade its secretariat. A statement by Chris Nehikhare, the publicity secretary of the Edo PDP Caretaker Committee alleged that the thugs were led by a relative of the APC’s state youth leader. Nehikhare said the invaders destroyed and carted away properties worth millions of naira. He said the political thugs also destroyed doors, windows, and office equipment at the party’s Secretariat. According to him, several electronics, computers and other valuable items were also carted away by the thugs, who ransacked the building with the plan to attack any person in the building. While condemning the attack, he opined that it was a desperate and reckless attempt by APC to intimidate PDP and frustrate the party’s efforts at reclaiming its mandate stolen at the September 21 governorship election. “It is quite disappointing and unfortunate that the APC, on Thursday, mobilised thugs to attack our party Secretariat in their desperation to frustrate and halt efforts by our great party to reclaim the mandate duly given to it by the Edo people at the September 21 governorship election. “If the APC are confident that they won the election free and square and have nothing to hide, why are they jittery and mobilising thugs to attack the PDP Secretariat? This is barbaric and totally condemnable,” he said. He urged the relevant security agencies to thoroughly investigate the attack and ensure that the perpetrators of the dastardly act are brought to book. He noted that PDP remains resolute and would not be intimidated or deterred in its pursuit of justice and the restoration of its mandate. Nehikhare called on members of the party and supporters to remain calm and be resolute in the face of the provocations as the leadership of the party is exploring every legal channel to reclaim its mandate. Reacting, the publicity secretary of the APC, Peter Uwadiae-Igbinigie, described the allegation as baseless and urged PDP to settle its internal crisis, warning that it should not drag the APC into its messy affair. Uwadiae-Igbinigie opined that it was absurd to label those who allegedly attacked the PDP office as APC thugs, wondering if the thugs wore APC uniforms or had APC paraphernalia on them. “APC government in the state has already embarked on a project the PDP government failed to carry out. We are still basking in the euphoria of our victory and putting the state on the right path. “How can the PDP say that the thugs that attacked their party secretariat are those of APC? Did the people have anything on them to show that they are APC members? The allegation is baseless and there is no proof. “The allegation is weighty and criminal in nature so the PDP should be sure they have proof before making the allegation. We will urge the PDP to sort out its internal problem and not drag the APC into it. “The APC government in the state is already embarking on projects that the PDP failed to do. These are projects that will better the lives of the people,” he said. By Aldgra Fredly Contributing Writer The Wright Patterson Air Force Base in Ohio temporarily closed its airspace on Friday after drone activity was detected in the area, a base spokesperson said on Sunday. Bob Purtiman, public affairs director for 88th Air Base Wing, told media outlets that the airspace was blocked after small unmanned aerial systems were spotted flying over the air base late Friday and early Saturday. Purtiman said installation leadership determined that none of the incursions impacted base residents, facilities, or assets. He told defense industry news outlet The War Zone that the drones ranged in size and configuration, without elaborating further. It was not immediately clear where the drones came from. The air base issued a Notice to Air Missions to announce the airspace closure after the drones were detected. The airspace has since been reopened. Purtiman said that the 88th Air Base Wing, the host unit for Wright Patterson Air Force Base, was working with local authorities in Ohio to ensure the safety of base personnel, facilities and assets. “The Air Force is taking all appropriate measures to safeguard our installations and residents,” he said. Located northeast of Dayton, Ohio, the Wright Patterson Air Force Base is home to Air Force Material Command, which conducts research, testing and evaluation, and provides acquisition management services and logistics support “necessary to keep Air Force weapon systems ready for war,” according to its website. The base also hosts the Air Force research laboratory and the National Air and Space Intelligence Center, which serves as the primary source of the U.S. Defense Department for “foreign air and space threats.” The incident occurred amid reports of unidentified drone-like objects flying over parts of New Jersey, New York and California. Alejandro Mayorkas, secretary of the Department of Homeland Security, said the federal government will take action to address concerns but signaled that officials don’t have the authority to shoot them down. “I want to assure the American public that we in the federal government have deployed additional resources, personnel, technology to assist the New Jersey State Police in addressing the drone sightings,” he told ABC News’ “This Week” anchor George Stephanopoulos on Sunday. Mayorkas said the sightings are “in fact” of drones, but some are “manned aircraft that are commonly mistaken for drones,” echoing previous statements made by the FBI and the White House.
