Anglers fishing the ice or open water at Racetrack Pond face a short walk in the months ahead because Superfund-related work on the adjacent Clark Fork River will commandeer the popular recreation spot’s parking. The latest work to address contamination along the Clark Fork River from historic mining and smelting upstream is scheduled to begin in January. The focus will be a stretch of stream and floodplain in the vicinity of Racetrack Pond in Powell County near the Deer Lodge County line. The Montana Department of Environmental Quality is in charge of cleanup and the state’s Natural Resource Damage Program has said it plans to integrate its restoration work with DEQ’s remediation. DEQ said the contractor will be Intermountain Construction Services of Butte. “They anticipate hitting the ground running [in mid-January],” said Logan Dudding, DEQ’s project manager for the Clark Fork. Work will begin upstream of the Racetrack Pond and proceed downstream. Stakes in a metals-contaminated 'slickens' near Racetrack Pond define a 'channel migration zone' and related cleanup boundaries for Phase 7 work, set to begin in mid-January. Phase 7 is scheduled for completion by October, he said. DEQ estimates the work will require removal of about 135,800 cubic yards of contaminated materials. (One formula suggests about 2.22 cubic yards would fit in a pickup with an 8-foot bed.) Wastes excavated along the river will be hauled by trucks to a repository in the Opportunity Ponds near Anaconda. A catastrophic flood in 1908 carried tons of toxic, metals-laced sediment downstream from mining and smelting operations in Butte and Anaconda, depositing contamination that covers more than 120 miles of floodplain. Contaminants of concern include arsenic, cadmium, copper, lead and zinc. Cleanup work began in 2010. DEQ has completed 7.5 of 22 phases of work along the 43 river miles between the Clark Fork River’s headwaters at Warm Springs and Garrison, a stretch of river known as Reach A. During a Monday online interview, DEQ’s Dudding, Jessica Banaszak, environmental project officer, and Katie Garcin-Forba discussed plans for Phase 7 and prospects for additional phases. Banaszak said the Phase 7 work will, as previously announced, reflect a more narrow “channel migration zone,” or CMZ, for excavation of wastes but will expand beyond that zone to address hot spots of contamination. She said efforts will be made to leave riparian vegetation where doing so is compatible with remediation goals. Critics of work upstream have said contractors removed too much riparian vegetation and undercut banks, interventions that might have played a part in the tailspin status of a once abundant population of brown trout in the upper river. Watchdogs of the federal Superfund work along the Clark Fork River worry that DEQ’s narrowing of the zone of work will result in leaving a troubling volume of wastes in place. The contraction of the CMZ was driven in part by concerns that money reached in settlements with Atlantic Richfield/BP for remediation and restoration will run out well before Garrison. Under Superfund law, Atlantic Richfield/BP is responsible for paying for remediation of the profound environmental pollution wrought in Butte, Anaconda and along Silver Bow Creek and the Clark Fork River by the Anaconda Co., which Atlantic Richfield bought in 1977. Garcin-Forba spoke to concerns about funding the remaining work. “We recognize, you know, that the settlement dollars will run out at some point, and so we’re gearing up as an agency, looking at what documentation do we need for a ‘round robin’ if we get to that point,” she said. The round robin process is spelled out in the 2008 Consent Decree for the Clark Fork River cleanup but doesn’t launch until the money is gone. EPA would pay the first $5 million, Montana the second $5 million and Atlantic Richfield/BP the third $5 million. Meanwhile, Garcin-Forba said decisions about remedial design must avoid leaving high levels of contamination in the floodplain that could be re-entrained into the Clark Fork. DEQ has said the agency still hopes to complete cleanup along the river to Garrison by 2038. There was no remedial construction work in 2024. A stretch of the upper Clark Fork River. In 2023, DEQ and the state’s Natural Resource Damage Program published a Strategic Plan for the Clark Fork River cleanup and restoration. Page 26 outlined goals for public engagement, which included, at a minimum, two public meetings a year, as well as annual budget projections after completion of each phase of work. DEQ has acknowledged a need to improve its record of public engagement. No budget projections were completed in 2024 because there was no construction, Banaszak said. After a global growth scare in July and early August, commodities recovered in September as the US Federal Reserve (Fed) lowered interest rates and China implemented a series of large monetary and fiscal stimulus actions in an effort to revive its stagnant economy. Within the Bloomberg Commodity Index, three of the four primary sub-complexes provided gains. Precious metals led results as slower growth, falling interest rates, a weaker US dollar and ongoing geopolitical tensions led the price of gold to a series of all-time highs during the quarter. Agriculture also closed the quarter with gains due to a September rally triggered by the weaker dollar and negative weather effects on coffee and sugar production. Similarly, a September rally in industrial metals helped copper, aluminum, nickel and zinc recover from early quarter losses as China’s policy stimulus efforts turned the tide. Energy declined as the sub-complex was simultaneously hit by apparent concerns that slowing growth would reduce demand and fear that the Organization of the Petroleum Exporting Countries (OPEC) would reverse voluntary production cuts, leading to oversupply. Performance highlights The fund provided a gain but underperformed the Bloomberg Commodity Index due to tactical positioning. Strategic precious metals were the largest contributor to absolute return due to strong gains in both gold and silver. The Fed’s 0.50% cut in the federal funds rate, combined with a 4% decline in the US dollar and China’s policy stimulus, helped gold reach record highs. However, the fund underperformed the benchmark primarily due to a strategic underweight and a tactical underweight in gold, despite a strategic overweight in silver. Gold is the largest holding in the fund and the benchmark. The fund’s strategic underweight is mostly a function of the benchmark rebalancing annually while the fund rebalances monthly. As gold prices have risen without what we would consider a significant pullback or correction, the benchmark’s gold weight has continued to increase while we have systematically paired backed the fund’s gains, thus managing its gold weighting. Strategic agriculture was the next largest contributor to absolute return due to gains in coffee and sugar. Coffee was the top-performing commodity across the full universe as hot and dry weather affected coffee producing countries, first in Vietnam and recently in the world’s largest producer, Brazil. Sugar had a double-digit gain in September, which moved its year-to-date return back into positive territory. Brazil’s hot and dry weather disrupted sugar production as heat and low humidity sparked a major outbreak of cane field fires. The fund’s agricultural exposure outperformed the benchmark mostly due to a strategic overweight in sugar and a tactical overweight in coffee, along with a strategic underweight and tactical net short in wheat. Strategic industrial metals added to absolute return as gains in August and September overcame July’s losses. Copper and aluminum were notable contributors to fund results. Both metals benefited from China’s September announcement of 11 major monetary and fiscal policy actions to support its housing market and consumer spending. The fund’s industrial metals holdings outperformed the benchmark due to strategic overweights in copper and aluminum, while tactical underweights in both metals offset some of the positive effect. Strategic energy was the largest detractor from absolute return as all six underlying exposures had double-digit declines for the quarter. Signs of economic slowdown have weighed on oil prices, compounded by OPEC announcing it will begin to reverse output cuts in December. Refined products were the largest detractors as supply is rising amid weaker demand. The fund underperformed the benchmark’s energy exposure due to tactical overweights in oil and refined products, whose losses more than offset relative gains from strategic underweights in oil and natural gas. Tactical underweights in agriculture and precious metals remained in place, but to a reduced degree. Energy transitioned from a net overweight to a net underweight. The net overweight in industrial metals increased. The tactical underweight in agriculture decreased as sugar and cotton moved from underweight to neutral and we reduced underweights in corn, soymeal and wheat. Tactical energy experienced the largest changes as oil, gasoil and heating oil all moved from overweight to underweight, while an overweight in gasoline was reduced and the tactical natural gas position remained underweight. Within tactical industrial metals, copper moved from neutral to overweight, aluminum transitioned from underweight to overweight and the tactical long position in zinc increased. Within tactical precious metals, gold was neutral, and we maintained the underweight in silver. We will rebalance the fund strategically and tactically again next month per our usual monthly cadence. Unlike more passive or index-based strategies, this once-a-month rebalancing increases our flexibility to position the fund according to prevailing market conditions and avoid concentrating risk in any one asset. Jared Polis digitally reached across the aisle last month by for Health and Human Services Secretary by President-elect Donald Trump. As an advocate who seeks bipartisan paths to advance public health policy, I welcomed the willingness to build a bridge with the incoming administration. However, when you ask Colorado voters of all political stripes, he was building a bridge to a dangerous place. When the governor posted that RFK Jr. “helped us defeat vaccine mandates in Colorado in 2019 and will help make Americans healthy again,” it reminded me of the oddest moment I’ve experienced at the Colorado state Capitol. In 2020, I was testifying in support of legislation to improve immunization rates among school-aged children. The bill was a modest compromise made with the governor and others, after a version from 2019 that included immunization mandates was defeated at the governor’s behest. Nonetheless, the chamber was swarmed with anti-vaccine activists who had been mobilized by figures including Kennedy. As I stood after finishing my testimony, an unwelcome chin was perched on my right shoulder from behind. It belonged to an opponent of the bill, who whispered in my ear, “sweet dreams ...” There was nothing problematic about the governor’s description of his successful partnership with Kennedy in defeating our bipartisan bill – that was accurate. The problem is that many of Kennedy’s views are well outside both the scientific consensus and bipartisan mainstream, and the health of Americans may suffer as a result. In Colorado, that’s already happening. Child immunization rates in our state are falling, putting kids at needless risk for illnesses that we had nearly driven into oblivion. In the 2022-23 school year, Colorado ranked 45th in the nation in kindergarten coverage rates for measles, at 86.8%, below the 92-94% community immunity threshold. Meanwhile, Coloradans support even stronger action than what’s currently being applied to protect children, as about three-quarters of voters believe that “before being able to send their children to schools and childcare centers, parents should be required to have them vaccinated for contagious diseases,” per a survey conducted this month by a bipartisan polling team for the organization I run, Healthier Colorado. President Eisenhower said, “every parent and every child should be grateful” when polio was essentially eradicated during his presidency over six decades ago. Now, even that vaccine is under attack by Kennedy, drawing the ire of polio survivor and Republican Senator Mitch McConnell. This adds to a string of dangerous and disproven positions taken by RFK, Jr., including the false linkage between vaccines and autism. We must not go back to proliferating the diseases of yesteryear, and a bipartisan majority of voters are pointing the way forward on health issues at the state and federal level. Here in Colorado, we have experienced the nation’s largest net decline in Medicaid enrollment since the pandemic, with more than half of that decline resulting from state bureaucratic failings. People who qualify for Medicaid are being excluded from coverage, leaving them without access to health care, and putting health providers into a financial bind with an increase in uninsured patients. Fortunately, 78% of Colorado voters, including over 68% of Republicans, are in favor of investing taxpayer dollars to fix this problem. Colorado can benefit from a strong working relationship with the Trump administration in selected areas, and Governor Polis is wise to pursue one. However, Coloradans reject Kennedy’s fringe views on vaccines, and a plurality believes that “doctors and scientists” have “too little” influence over public health policy. This isn’t an elitist view, it’s common sense – only 28% percent of Coloradans with a high school education or less think that doctors and scientists have “too much” influence. Poll after poll shows that Polis is on the right track with his successful effort to save people money on health care. Moreover, this month’s poll showed alignment with the sentiment expressed by the governor and Kennedy about the influence of the pharmaceutical and processed foods industries, as about 7 in 10 Colorado voters agree. On these and other issues, we can take a pragmatic approach that moves us forward, not backward, so we can improve people’s well-being and save lives.
