Article content A 7-year-old rivalry between tech leaders Elon Musk and Sam Altman over who should run OpenAI and prevent an artificial intelligence “dictatorship” is now heading to a federal judge as Musk seeks to halt the ChatGPT maker’s ongoing shift into a for-profit company. Recommended Videos Musk, an early OpenAI investor and board member, sued the artificial intelligence company earlier this year alleging it had betrayed its founding aims as a nonprofit research lab benefiting the public good rather than pursuing profits. Musk has since escalated the dispute, adding new claims and asking for a court order that would stop OpenAI’s plans to convert itself into a for-profit business more fully. The world’s richest man, whose companies include Tesla, SpaceX and social media platform X, last year started his own rival AI company, xAI. Musk says it faces unfair competition from OpenAI and its close business partner Microsoft, which has supplied the huge computing resources needed to build AI systems such as ChatGPT. “OpenAI and Microsoft together exploiting Musk’s donations so they can build a for-profit monopoly, one now specifically targeting xAI, is just too much,” says Musk’s filing that alleges the companies are violating the terms of Musk’s foundational contributions to the charity. OpenAI is filing a response Friday opposing Musk’s requested order, saying it would cripple OpenAI’s business and mission to the advantage of Musk and his own AI company. A hearing is set for January before U.S. District Judge Yvonne Gonzalez Rogers in Oakland. At the heart of the dispute is a 2017 internal power struggle at the fledgling startup that led to Altman becoming OpenAI’s CEO. Musk also wanted the job, according to emails revealed as part of the court case, but grew frustrated after two other OpenAI co-founders said he would hold too much power as a major shareholder and chief executive if the startup succeeded in its goal to achieve better-than-human AI known as artificial general intelligence, or AGI. Musk has long voiced concerns about how advanced forms of AI could threaten humanity. “The current structure provides you with a path where you end up with unilateral absolute control over the AGI,” said a 2017 email to Musk from co-founders Ilya Sutskever and Greg Brockman. “You stated that you don’t want to control the final AGI, but during this negotiation, you’ve shown to us that absolute control is extremely important to you.” In the same email, titled “Honest Thoughts,” Sutskever and Brockman also voiced concerns about Altman’s desire to be CEO and whether he was motivated by “political goals.” Altman eventually succeeded in becoming CEO, and has remained so except for a period last year when he was fired and then reinstated days later after the board that ousted him was replaced. OpenAI published the messages Friday in a blog post meant to show its side of the story, particularly Musk’s early support for the idea of making OpenAI a for-profit business so it could raise money for the hardware and computer power that AI needs. It was Musk, through his wealth manager Jared Birchall, who first registered “Open Artificial Technologies Technologies, Inc.”, a public benefit corporation, in September 2017. Then came the “Honest Thoughts” email that Musk described as the “final straw.” “Either go do something on your own or continue with OpenAI as a nonprofit,” Musk wrote back. OpenAI said Musk later proposed merging the startup into Tesla before resigning as the co-chair of OpenAI’s board in early 2018. Musk didn’t immediately respond to emailed requests for comment sent to his companies Friday. Asked about his frayed relationship with Musk at a New York Times conference last week, Altman said he felt “tremendously sad” but also characterized Musk’s legal fight as one about business competition. “He’s a competitor and we’re doing well,” Altman said. He also said at the conference that he is “not that worried” about the Tesla CEO’s influence with President-elect Donald Trump. OpenAI said Friday that Altman plans to make a $1 million personal donation to Trump’s inauguration fund, joining a number of tech companies and executives who are working to improve their relationships with the incoming administration. — The Associated Press and OpenAI have a licensing and technology agreement allowing OpenAI access to part of the AP’s text archives.q9 casino

The look was paired with the all-black ensemble of a curve-hugging top, sheer tights, and thigh-high boots, while she chose a velvet, floor-length trench coat for outerwear. For beauty, Aguilera rocked her blonde tresses down straight, middle-parted, and opted for neutral, shimmery makeup with a mauve-colored glossy lip. The Ministry of Marine and Blue Economy, on Thursday, expressed full support towards the establishment of the Nigerian Coast Guard, to support the sustainable development of the Marine and Blue Economy sector. The Minister of Marine and Blue Economy, Adegboyega Oyetola, made this expression at the National Assembly Complex, Abuja, at a one-day public hearing, organised by the Senate Committee on Marine Transport on the Nigerian Coast Guard Establishment Bill, 2024. Oyetola noted that the Nigerian Coast Guard would act as a vital complement to the Navy, fostering a safe and sustainable maritime environment that is aligned with international best practices, saying that the initiative would strengthen Nigeria’s blue economy, protect the nation’s natural resources, and ensure prosperity for future generations. According to the Minister, a flexible, adaptive implementation strategy should be evolved to midwife its establishment, noting that the Ministry also encourages those with reservations to see the pressing need for the institution and rally in support of the endeavour. While delivering his speech, he particularly commended the efforts of the Senate Committee on Maritime Transport and its Chairman, Senator Wasiu Eshinlokun Sanni, who sponsored the bill, saying that the depth of synergy between the aspiration of the Executive arm of government and that of the Legislature should be encouraged. He said: “The imperative for the establishment of a National Coast Guard, to support the sustainable development of the Marine and Blue Economy sector is apt. “By initiating the Nigerian Coast Guard [Establishment] Bill, the National Assembly (NASS) is setting a course towards enhanced economic growth, maritime safety, and sustainable marine resource development. “This public hearing is a testament to the growth of our democracy and the exemplary leadership of His Excellency, Senator Godswill Akpabio GCON the President of the Senate. “In particular the Ministry wishes to commend the efforts of the Senate Committee on Maritime Transport and its Chairman, Senator Wasiu Eshinlokun Sanni for this initiative. This depth of synergy between the aspiration of the Executive arm of government and that of the Legislature should be encouraged. It is a cardinal objective of the Renewed Hope Agenda of this administration, led by our pragmatic President, His Excellency, President Bola Ahmed Tinubu GCFR. “The Federal Ministry of Marine and Blue Economy is therefore pleased to applaud the initiators of this Bill and the entire National Assembly, particularly this esteemed Senate, for this noble move and its dedication to Nigeria’s blue economy. “The ministry expresses its support and endorsement of the proposed Bill and strongly recommends that the Bill be given objective consideration. “Nigeria has a vast coastline of 853 kilometres, including 10,000 kilometres of inland waterways. It is also blessed with rich and diverse marine resources. The exploitation of marine and blue economy potentials usually comes with inevitable consequences which necessitate special institutional arrangements to guarantee safety and conservation. “The existential threat from human activities, include pollution, unregulated coastal development, overfishing and unsustainable exploitation of marine resources, among others. It must be emphasized that the protection and sustainable use of marine ecosystems is a vital pathway for national development. It is therefore compelling to preserve these endowments and guarantee sustainable development.” Speaking on why Nigeria needs a National Coast Guard, Oyetola said: “It is very important to give credit to the Nigerian Navy for its achievements in safeguarding the Nigerian maritime space and giving Nigeria a good image worldwide. Its collaborative effort with the Ministry of Marine and Blue Economy, its agency- the Nigerian Maritime Administration and Safety Agency (NIMASA) in the Deep Blue Project has shown great results with zero piracy in Nigeria’s territorial water in the last three years. However, there is a need to further complement the efforts of our Navy as it is done in other climes. “According to a 2009 publication by the Africa Centre for Strategic Studies, 15 out of the 21 independent maritime nations in sub-Saharan Africa have dedicated coast guards, that identify themselves as such and none has our population and many of these countries do not have the length of our inland waterways or coastline. “Also, a 2015 publication by the Institute for Security Studies of the National Defence College of Nigeria highlighted the impact of activities such as illegal, unregulated and unreported fishing in the inland waters, coastal and marine fishing zones in sub-Saharan Africa, which is estimated to cost the region approximately between US$ 3 billion to US$ 5 billion a year in lost revenue. “The Lagos – Calabar Coastal Highway development is a major game changer for the entire coastline of the country. The project is expected to unlock the region’s blue economy potential. Hotels, beach resorts, water parks, eco-parks, ferry services, hospitality industries, industrial parks and more are soon to spring up along the coastline. “This increase in economic activities will require a dedicated institution that will be responsible for ensuring maritime safety, search and rescue, environmental protection, and the enforcement of civil maritime laws. “The spate of boats mishap within our inland waterways is also a strong justification for the need to strengthen our maritime safety and the enforcement of maritime laws and regulations in the inland waterways. This is necessary to boost maritime trade and trans-shipment in Nigeria. “Also, considering Nigeria’s critical position in the maritime domain on the continent and globally, the establishment of a National Coast Guard would further increase our standing in the comity of maritime nations. This will no doubt attract foreign support and assistance.”A little feast

BOULDER — Exhale, Colorado fans. Friday's regular-season finale won’t be the final time Shedeur Sanders and Travis Hunter put on the Buffaloes uniform. “We’ve got a bowl game. I’m pretty sure we secured that weeks ago for Peggy (Coppom),” Deion Sanders said Tuesday. “It’s not the last time you’re gonna see them in a Buff uniform.” It was a fair question. With both Shedeur and Hunter projected to be picked near the top of the 2025 NFL draft, they would be far from the first (or last) stars to sit out a bowl game. Hunter said last week he wouldn’t, nor would he believe anyone else would skip out on a College Football Playoff game. Colorado quarterback Shedeur Sanders prepares to call a play during the first half of an NCAA college football game against Kansas, Saturday, Nov. 23, 2024, in Kansas City, Mo. (AP Photo/Charlie Riedel) The Buffs are still in play for a Big 12 championship, but they would need help this weekend. Coach Prime believes the team owes it to the fans to wear the Colorado uniform for the duration of the season. No. 23 Colorado hosts Oklahoma State at 10 a.m. Friday. “These two and all the rest of the seniors have done a wonderful job of getting us to where we are, installing much expectation in our fan base and expectation in ourselves,” Deion said. “We’re gonna fight and try to go out there and kick some butt and end this thing on the right note. We’re gonna go to a bowl game and end this thing on the right note because our fans deserve the absolute best and I feel like whatever bowl game we’re chosen to go to or whatever we choose, we’re gonna pack it, we’re gonna do what we normally do wherever we go on the road and it’s gonna be a tremendous game. “You’re gonna see everything you’ve seen throughout the season, regarding our athletes.” It would also be the last time Coach Prime would share the field with his sons, Shedeur and Shilo, and Hunter, whom he considers to be like a son. The trio will be off to the NFL next year. A final game with his sons, whenever it comes, isn’t on Coach Prime’s mind right now. “I’m not focused on my last hoorah with my kids, I’m focused on winning this last game with my team,” he said. Deion Sanders is ready to give back one of his trophies. Travis Hunter was named a finalist for four major college football awards on Tuesday: the Maxwell (best player), Walter Camp (best player), Bednarik (best defensive player) and Biletnikoff (best wide receiver). Hunter already had been named a finalist for the Paul Hornung award, which he won last season as college football's most versatile player. But it was the one he wasn’t a finalist for that bothered Coach Prime. Kansas wide receiver Luke Grimm (11) and Colorado corner back Travis Hunter (12) talk between plays during the first half of an NCAA college football game, Saturday, Nov. 23, 2024, in Kansas City, Mo. (AP Photo/Charlie Riedel) “How is Travis Hunter snubbed by the Jim Thorpe Award?” Sanders asked a room of reporters in attendance for his weekly press conference. The award is given annually to the country’s top defensive back and Sanders was bewildered that his star cornerback wasn’t among the three finalists. It’s an award Sanders won in 1988 during his final season at Florida State. “You can have my award. You can have it back,” Coach Prime said. “Matter of fact, I’m gonna give him (my trophy). I ain’t using it. It’s just sitting up there collecting dust. Travis can have my Thorpe Award because if this ain’t the most idiotic thing in college football that he’s not a finalist for the Jim Thorpe Award and he is, I would say arguably, but I don’t think it’s really an argument about this young man being the best defensive back in college football.” It is fair to wonder how Hunter is a finalist for the award given to the nation’s best overall defender, but not a finalist for the award for his specific defensive position. “He rarely gets thrown at, he’s won a game (by) tackling for us and he’s always on point,” Sanders said. “If you bring up statistics, I don’t know how in the world Travis Hunter is not a finalist for the Jim Thorpe Award. They just pretty much messed up all the integrity of the award. He can have mine. I don’t even want mine now.” Shedeur Sanders was also named a finalist for a major award, as he is one of three players up for the Davey O’Brien Award, given annually to the nation’s top quarterback.Delivers Outperformance Across All First Quarter Guided Metrics Reports 18% YoY ARR Growth and Strong Free Cash Flow SAN JOSE, Calif., Nov. 26, 2024 (GLOBE NEWSWIRE) -- Nutanix, Inc. Footnotes 1 Annual Recurring Revenue , or ARR , for any given period, is defined as the sum of ACV for all subscription contracts in effect as of the end of a specific period. For the purposes of this calculation, we assume that the contract term begins on the date a contract is booked, unless the terms of such contract prevent us from fulfilling our obligations until a later period, and irrespective of the periods in which we would recognize revenue for such contract. Excludes all life-of-device contracts. ACV is defined as the total annualized value of a contract. The total annualized value for a contract is calculated by dividing the total value of the contract by the number of years in the term of such contract. Excludes amounts related to professional services and hardware. 2 Average Contract Duration represents the dollar-weighted term, calculated on a billings basis, across all subscription contracts, as well as our limited number of life-of-device contracts, using an assumed term of five years for life-of-device licenses, executed in the period. 3 Weighted average share count used in computing diluted non-GAAP net income per share. Non-GAAP Financial Measures and Other Key Performance Measures To supplement our consolidated financial statements, which are prepared and presented in accordance with GAAP, this press release includes the following non-GAAP financial and other key performance measures: non-GAAP gross margin, non-GAAP operating expenses, non-GAAP operating income, non-GAAP operating margin, free cash flow, Annual Recurring Revenue (or ARR), and Average Contract Duration. In computing non-GAAP financial measures, we exclude certain items such as stock-based compensation and the related income tax impact, costs associated with our acquisitions (such as amortization of acquired intangible assets, income tax-related impact, and other acquisition-related costs), restructuring charges, litigation settlement accruals and legal fees related to certain litigation matters, the amortization and conversion of the debt discount and issuance costs related to convertible senior notes, interest expense related to convertible senior notes, and other non-recurring transactions and the related tax impact. Non-GAAP gross margin, non-GAAP operating expenses, non-GAAP operating income, and non-GAAP operating margin are financial measures which we believe provide useful information to investors because they provide meaningful supplemental information regarding our performance and liquidity by excluding certain expenses and expenditures such as stock-based compensation expense that may not be indicative of our ongoing core business operating results. Free cash flow is a performance measure that we believe provides useful information to our management and investors about the amount of cash generated by the business after capital expenditures, and we define free cash flow as net cash provided by (used in) operating activities less purchases of property and equipment. ARR is a performance measure that we believe provides useful information to our management and investors as it allows us to better track the topline growth of our subscription business because it takes into account variability in term lengths. We use these non-GAAP financial and key performance measures for financial and operational decision-making and as a means to evaluate period-to-period comparisons. However, these non-GAAP financial and key performance measures have limitations as analytical tools and you should not consider them in isolation or as substitutes for analysis of our results as reported under GAAP. Non-GAAP gross margin, non-GAAP operating expenses, non-GAAP operating income, non-GAAP operating margin, and free cash flow are not substitutes for gross margin, operating expenses, operating income (loss), operating margin, or net cash provided by (used in) operating activities, respectively. There is no GAAP measure that is comparable to ARR or Average Contract Duration, so we have not reconciled the ARR or Average Contract Duration data included in this press release to any GAAP measure. In addition, other companies, including companies in our industry, may calculate non-GAAP financial measures and key performance measures differently or may use other measures to evaluate their performance, all of which could reduce the usefulness of our non-GAAP financial measures and key performance measures as tools for comparison. We urge you to review the reconciliation of our non-GAAP financial measures and key performance measures to the most directly comparable GAAP financial measures included below in the tables captioned “Reconciliation of GAAP to Non-GAAP Profit Measures” and “Reconciliation of GAAP Net Cash Provided By Operating Activities to Non-GAAP Free Cash Flow,” and not to rely on any single financial measure to evaluate our business. This press release also includes the following forward-looking non-GAAP financial measures as part of our second quarter fiscal 2025 outlook and/or our fiscal 2025 outlook: non-GAAP operating margin and free cash flow. We are unable to reconcile these forward-looking non-GAAP financial measures to their most directly comparable GAAP financial measures without unreasonable efforts, as we are currently unable to predict with a reasonable degree of certainty the type and extent of certain items that would be expected to impact the GAAP financial measures for these periods but would not impact the non-GAAP financial measures. He said the Sindh Assembly had passed a record number of bills and the opposition lawmakers had complete freedom of expression in the House to raise issues of public importance. The meeting discussed affairs related to legislation and politics in Sindh. The two sides also considered cooperation between the US and Pakistan to tackle environmental challenges. The US delegation praised the progressive ideas and conduct of the speaker.

New Jersey Gov. Phil Murphy and U.S. Sen. Andy Kim have both gone out on drone hunts, hoping for answers. The FBI, Homeland Security, state police and other agencies are investigating. Murphy and law enforcement officials have stressed that the drones don’t appear to be a threat to public safety, but many state and municipal lawmakers have nonetheless called for stricter rules about who can fly the unmanned aircraft — and to be allowed to shoot them out of the sky. Dozens of witnesses have reported seeing drones statewide since mid-November, including near the Picatinny Arsenal, a military research and manufacturing facility, and over President-elect Donald Trump’s golf course in Bedminster. Murphy, a Democrat, said Monday that equipment supplied by the federal government has yielded little new information. He declined to describe the equipment except to say it was powerful and could even “mitigate” the drones, though he added that’s not currently legal on U.S. soil. The state tallied 12 sightings Saturday and just one on Sunday. Murphy urged Congress to give states more authority to deal with the drones. The growing anxiety among some residents is not lost on the Biden administration, which has faced criticism from Trump for not dealing with the matter more aggressively. White House national security spokesman John Kirby on Monday said the federal government has yet to identify any public safety or national security risks from reported drone sightings in the northeast, saying officials believe they were lawfully flown drones, planes or even stars. “There are more than 1 million drones that are lawfully registered with the Federal Aviation Administration here in the United States,” Kirby said. “And there are thousands of commercial, hobbyist and law enforcement drones that are lawfully in the sky on any given day. That is the ecosystem that we are dealing with.” The federal government has deployed personnel and advanced technology to investigate the reports in New Jersey and other states, and is evaluating each tip reported by citizens, he said. The FBI received more than 5,000 tips in recent weeks, he added, with only “about 100” deemed credible enough to require additional investigation. Authorities say they do not know. The Department of Homeland Security and FBI said they have no evidence that the aircraft pose “a national security or public safety threat or have a foreign nexus.” Speculation has nevertheless raged online, with some expressing concerns that the drones could be part of a nefarious plot by foreign agents. Officials stress that ongoing investigations have found no evidence to support such concerns, but U.S. Rep Chris Smith, a Republican, on Saturday echoed such speculation. “The elusive maneuvering of these drones suggests a major military power sophistication that begs the question whether they have been deployed to test our defense capabilities — or worse — by violent dictatorships, perhaps maybe Russia, or China, or Iran, or North Korea,” he said. On Monday, Pentagon spokesperson Maj. Gen. Pat Ryder cast doubt on the idea that the drones are engaged in intelligence gathering, given how loud and bright they are. He said about 1 million drones are registered drones in the U.S. and about 8,000 flying on any given day. Pentagon spokeswoman Sabrina Singh has said the aircraft are not U.S. military drones. Drones flying around Wright-Patterson Air Force Base near Dayton, Ohio, forced base officials to close its airspace for about four hours late Friday into early Saturday, said Robert Purtiman, a base spokesperson. It was the first time drones had been spotted at the base, one of the largest in the world, and no sightings have been reported since, Purtiman said Monday. He said the drones had no impact on any facilities on the base. Trump has said he believes the government knows more than it’s saying. “Let the public know, and now. Otherwise, shoot them down!!!” he posted on Truth Social. Kim said he’s heard no support for the notion the government is hiding anything. He said a lack of faith in institutions is playing a key part in the saga. “Nothing that I’m seeing, nothing that I’ve engaged in gives me any impression of that nature. But like, I get it, some people won’t believe me, right? Because that’s the level of distrust that we face,” Kim said Monday. Sen. Richard Blumenthal of Connecticut last week called for the drones to be “shot down.” Rep. Smith urged the Pentagon to authorize the use of force to bring down one or more drones to try to figure out who deployed them. The objects could be downed over the ocean or in an unpopulated area on land, Smith said Saturday. “Why can’t we bag at least one of these drones and get to the bottom of it?” Smith said.
