Just after Apple was sued for using surveillance in technology , the Equal Employment Opportunity Commission (EEOC) issued guidance for employers regarding employee use of wearable technology. The 21st Century has seen numerous technological advances with the impressive ability to track the person wearing the device's activities and monitor their sleep schedule, stress levels, heart rate, and blood pressure. Some of the technology can even perform diagnostic testing, such as an electroencephalogram. Employers who require employees to wear technology that tracks physical and mental conditions may be conducting “medical examinations” under the Americans with Disabilities Act (ADA). Specifically, the EEOC indicates the “ADA strictly limits disability-related inquiries or medical examinations for all employees, not just those with disabilities, to situations when it is ‘job related and consistent with business necessity’ for a specific employee, or otherwise permitted under the ADA, 42 U.S.C. § 12112(d)(4)(A).” The ADA provides that a medical examination or a disability-related inquiry is “job related and consistent with business necessity” when an employee has a medical condition that poses a significant safety risk that cannot be reduced by means of providing a reasonable accommodation. Purely by way of example, a disability-related inquiry or medical examination is only permitted when required by federal or state safety-related laws or regulations, employees in certain positions (i.e., police officers and firefighters), and when the inquiry or examination is part of an employee health program designed to promote health or prevent disease. If the inquiry or examination is outside these statutorily authorized purposes, then an employer risks being noncompliant with the ADA. Moreover, when an employer collects the data described above, employers are required to maintain those records separately and treat that data as confidential medical information. Notably, the EEOC says employers may also be required to make an exception to a wearable technology policy as a reasonable accommodation under Title VII, the ADA, or the Pregnant Workers Fairness Act, even if the ADA allowed an employer to collect medical information from wearable technology. Based on the EEOC's guidance, employers who are contemplating implementing wearable technology policies, or who already have them in place, should ensure they follow applicable laws and policies.

LOS ANGELES — Considering how their seasons have ebbed and flowed so far, and the history between the stars leading their teams, it’s only appropriate that the Lakers and Golden State Warriors match up for a Christmas Day showdown on Wednesday at Chase Center. Just a month ago, the Lakers and Warriors were sitting near the top of the Western Conference standings, opening the season with 10-5 and 12-3 records, respectively, entering Nov. 23. How much a month can change things. The Lakers (16-13) have gone 6-8 since then after dropping Monday’s home game to the Detroit Pistons to end their three-game winning streak. And the Warriors (15-13) have been even worse, winning just three of their last 13 games after starting the year at the top of the conference. But Wednesday will be another matchup between Lakers star LeBron James and Warriors star Steph Curry – two all-time greats whose careers have intersected to the point they’re considered by many to have one of the defining rivalries of the league’s modern era. “Anytime you get an opportunity to be on the court and compete versus one of the greats to ever play this game, you never take it for granted,” James said. “I don’t know how many more opportunities we’re gonna get to go against each other, so it’s always fun.” Wednesday will also mark the second time the Lakers and Warriors have played each other on Christmas in the past seven years, with the Lakers beating the Warriors on Dec. 25, 2018, in James’ first season with the Lakers. Sebastian Zapeta, 33, who federal immigration officials said is a Guatemalan citizen who entered the U.S. illegally, was arraigned in Brooklyn criminal court. He appeared briefly before a judge and wore a white jumpsuit over a weathered black hooded sweatshirt. He did not speak. He will remain jailed ahead of his next court date on Friday. The apparently random attack occurred Sunday morning on a stationary F train at the Coney Island station in Brooklyn. Police said Tuesday that identification of the victim was still “pending at this time.” Authorities say Zapeta approached the woman, who was sitting motionless in the train car and may have been sleeping, and used a lighter to set her clothing on fire. The woman quickly became engulfed in flames, while the suspect then sat at a bench on the subway platform and watched, according to police. Video posted to social media appeared to show the woman standing inside the train ablaze as some people look on from the platform, and at least one officer walks by. NYPD Chief of Transit Joseph Gulotta said Sunday that several officers had responded to the fire and one stayed to keep the crime scene “the way it’s supposed to be" while the others went to get fire extinguishers and transit workers. They were eventually able to douse the fire, but “unfortunately, it was too late,” Police Commissioner Jessica Tisch said — the woman was pronounced dead at the scene. During Zapeta's court hearing on Tuesday, Assistant District Attorney Ari Rottenberg said Zapeta at one point fanned the flames on the woman using his shirt. He said a 911 call from a subway rider helped identify Zapeta. Rottenberg added that under interrogation Zapeta claimed he didn’t know what happened, noting that he consumes alcohol. But he alleged that Zapeta identified himself to interrogators in images related to the attack. Zapeta was taken into custody Sunday afternoon while riding a train on the same subway line after police got a tip from some teenagers who recognized him from images circulated by the police. A Brooklyn address for Zapeta released by police matches a shelter that provides housing and substance abuse support. The shelter did not immediately respond to a request for comment. Federal immigration officials said Zapeta had been previously deported in 2018 but at some point reentered the U.S. illegally. In a statement, Brooklyn District Attorney Eric Gonzalez called the attack a “gruesome and senseless act of violence against a vulnerable woman” that would be “met with the most serious consequences.” The crime — and the graphic video of it that ricocheted across social media — deepened a growing sense of unease among some New Yorkers about the safety of the subway system in a city where many residents take the subway multiple times each day. Overall, according to authorities, crime is down in the transit system this year when compared to last year — major felonies declined 6% between January and November of this year and in 2023, data compiled by the Metropolitan Transportation Authority show. But murders are up, with nine killings this year through November compared to five in the same period last year. Earlier this month, a Manhattan jury acquitted Daniel Penny in the death of an agitated subway rider that the former Marine placed in a chokehold last year. Spanish King Felipe VI used his traditional Christmas Eve speech to remember the victims of the catastrophic Valencia flash floods, and urged the country to remain calm while addressing hot-button issues such as immigration and housing affordability. In a pre-recorded speech that usually reviews the year's most relevant issues, Felipe said Spain “must never forget the pain and sadness" the floods caused. The Oct. 29 floods killed more than 225 people in eastern Spain, damaging countless homes and leaving graveyards of cars piled on top of each other. In some towns, the heavy downpours that caused the floods dropped as much as a year's worth of rain in just eight hours. In early November, as Spaniards' shock at the wreckage turned into frustration, a political blame game began, directed especially at regional authorities who failed to send timely emergency alerts to cell phones on the day of the floods. The frustration of residents in hard-hit Paiporta near Valencia was on display when people tossed mud and shouted insults at the king and government officials in early November when they made their first visit to the town. “We have seen — and understood — the frustration, the pain, the impatience, the demands for greater and more effective coordination," Felipe said about how the disaster was managed. Morán, who turns 28 in late April, will not go on Boston’s 40-man roster but does have a fair amount of big league time with the Twins. He emerged as an important member of Minnesota’s bullpen in 2022 (posting a 2.21 ERA and striking out 54 batters) and in total, has a 4.15 ERA in 91 innings over the last three years. The Puerto Rico native struggled to a 5.31 ERA in 43 games, then missed the end of the season due to a forearm strain before undergoing Tommy John surgery after the year. The Twins non-tendered him, then re-signed him to a minor league contract before he missed all of 2024. It’s unclear if Morán will be ready for Opening Day, but when he is healthy, he’ll provided a left-handed depth option for the Red Sox, who have changed up that area of their roster so far this winter by adding veterans Aroldis Chapman and Justin Wilson and dealing off Booser. Wilson, Chapman, Brennan Bernardino, Zach Penrod and the rehabbing Chris Murphy are on the 40-man roster, Morán will likely begin the year at Triple-A.
