By ALEXANDRA OLSON and CATHY BUSSEWITZ NEW YORK (AP) — Walmart’s sweeping rollback of its diversity policies is the strongest indication yet of a profound shift taking hold at U.S. companies that are revaluating the legal and political risks associated with bold programs to bolster historically underrepresented groups in business. The changes announced by the world’s biggest retailer followed a string of legal victories by conservative groups that have filed an onslaught of lawsuits challenging corporate and federal programs aimed at elevating minority and women-owned businesses and employees. The risk associated with some of programs crystalized with the election of former President Donald Trump, whose administration is certain to make dismantling diversity, equity and inclusion programs a priority. Trump’s incoming deputy chief of policy will be his former adviser Stephen Miller , who leads a group called America First Legal that has aggressively challenged corporate DEI policies. “There has been a lot of reassessment of risk looking at programs that could be deemed to constitute reverse discrimination,” said Allan Schweyer, principal researcher the Human Capital Center at the Conference Board. “This is another domino to fall and it is a rather large domino,” he added. Among other changes, Walmart said it will no longer give priority treatment to suppliers owned by women or minorities. The company also will not renew a five-year commitment for a racial equity center set up in 2020 after the police killing of George Floyd. And it pulled out of a prominent gay rights index . Schweyer said the biggest trigger for companies making such changes is simply a reassessment of their legal risk exposure, which began after U.S. Supreme Court’s ruling in June 2023 that ended affirmative action in college admissions. Since then, conservative groups using similar arguments have secured court victories against various diversity programs, especially those that steer contracts to minority or women-owned businesses. Most recently, the conservative Wisconsin Institute for Law & Liberty won a victory in a case against the U.S. Department of Transportation over its use of a program that gives priority to minority-owned businesses when it awards contracts. Companies are seeing a big legal risk in continuing with DEI efforts, said Dan Lennington, a deputy counsel at the institute. His organization says it has identified more than 60 programs in the federal government that it considers discriminatory, he said. “We have a legal landscape within the entire federal government, all three branches — the U.S. Supreme Court, the Congress and the President — are all now firmly pointed in the direction towards equality of individuals and individualized treatment of all Americans, instead of diversity, equity and inclusion treating people as members of racial groups,” Lennington said. The Trump administration is also likely to take direct aim at DEI initiatives through executive orders and other policies that affect private companies, especially federal contractors. “The impact of the election on DEI policies is huge. It can’t be overstated,” said Jason Schwartz, co-chair of the Labor & Employment Practice Group at law firm Gibson Dunn. With Miller returning to the White House, rolling back DEI initiatives is likely to be a priority, Schwartz said. “Companies are trying to strike the right balance to make clear they’ve got an inclusive workplace where everyone is welcome, and they want to get the best talent, while at the same time trying not to alienate various parts of their employees and customer base who might feel one way or the other. It’s a virtually impossible dilemma,” Schwartz said. A recent survey by Pew Research Center showed that workers are divided on the merits of DEI policies. While still broadly popular, the share of workers who said focusing on workplace diversity was mostly a good thing fell to 52% in the November survey, compared to 56% in a similar survey in February 2023. Rachel Minkin, a research associated at Pew called it a small but significant shift in short amount of time. There will be more companies pulling back from their DEI policies, but it likely won’t be a retreat across the board, said David Glasgow, executive director of the Meltzer Center for Diversity, Inclusion and Belonging at New York University. “There are vastly more companies that are sticking with DEI,” Glasgow said. “The only reason you don’t hear about it is most of them are doing it by stealth. They’re putting their heads down and doing DEI work and hoping not to attract attention.” Glasgow advises organizations to stick to their own core values, because attitudes toward the topic can change quickly in the span of four years. “It’s going to leave them looking a little bit weak if there’s a kind of flip-flopping, depending on whichever direction the political winds are blowing,” he said. One reason DEI programs exist is because without those programs, companies may be vulnerable to lawsuits for traditional discrimination. “Really think carefully about the risks in all directions on this topic,” Glasgow said. Walmart confirmed will no longer consider race and gender as a litmus test to improve diversity when it offers supplier contracts. Last fiscal year, Walmart said it spent more than $13 billion on minority, women or veteran-owned good and service suppliers. It was unclear how its relationships with such business would change going forward. Organizations that that have partnered with Walmart on its diversity initiatives offered a cautious response. The Women’s Business Enterprise National Council, a non-profit that last year named Walmart one of America’s top corporation for women-owned enterprises, said it was still evaluating the impact of Walmart’s announcement. Pamela Prince-Eason, the president and CEO of the organization, said she hoped Walmart’s need to cater to its diverse customer base will continue to drive contracts to women-owned suppliers even if the company no longer has explicit dollar goals. “I suspect Walmart will continue to have one of the most inclusive supply chains in the World,” Prince-Eason wrote. “Any retailer’s ability to serve the communities they operate in will continue to value understanding their customers, (many of which are women), in order to better provide products and services desired and no one understands customers better than Walmart.” Related Articles National News | Bird flu virus was found in raw milk. Several of those companies have subsequently announced that they are pulling back their initiatives, including Ford , Harley-Davidson, Lowe’s and Tractor Supply . Walmart confirmed to The Associated Press that it will better monitor its third-party marketplace items to make sure they don’t feature sexual and transgender products aimed at minors. The company also will stop participating in the Human Rights Campaign’s annual benchmark index that measures workplace inclusion for LGBTQ+ employees. A Walmart spokesperson added that some of the changes were already in progress and not as a result of conversations that it had with Starbuck. RaShawn “Shawnie” Hawkins, senior director of the HRC Foundation’s Workplace Equality Program, said companies that “abandon” their commitments workplace inclusion policies “are shirking their responsibility to their employees, consumers, and shareholders.” She said the buying power of LGBTQ customers is powerful and noted that the index will have record participation of more than 1,400 companies in 2025.
CLEVELAND (AP) — Shortly after doing a face-down snow angel, firing a few celebratory snowballs and singing “Jingle Bells” on his way to the media room, Jameis Winston ended his postgame news conference with a simple question. “Am I a Brown yet?” he asked. He is now. And who knows? Maybe for a lot longer than expected. Winston entered Cleveland football folklore on Thursday night by leading the Browns to a 24-19 win over the division rival Pittsburgh Steelers, who had their five-game winning streak stopped. Winston's performance at Huntington Bank Field, which transformed into the world's largest snow globe, not only made him an instantaneous hero in the eyes of Browns fans but added another wrinkle to the team's ever-changing, never-ending quarterback conundrum. In his fourth start since Deshaun Watson's season-ending Achilles tendon injury, Winston made enough big plays to help the Browns (3-8) get a victory that should quiet conjecture about coach Kevin Stefanski's job. Some wins mean more than others. In Cleveland, beating the Steelers is as big as it gets. But beyond any instant gratification, Winston has given the Browns more to consider as they move forward. Watson's future with Cleveland is highly uncertain since it will still be months before the team has a grip on whether he's even an option in 2025, his fourth year since signing a $230 million, fully guaranteed contract that has proven calamitous. It's also possible the Browns will cut ties with Watson. They signed Winston to a one-year contract to be Watson's backup. But the unexpected events of 2024 have changed plans and led to the possibility that the 30-year-old Winston could become Cleveland's full-time QB or a bridge to their next young one. So much is unclear. What's not is that Winston, who leaped into the end zone on fourth-and-2 for a TD to put the Browns ahead 18-6 in the fourth quarter, is a difference maker. With his larger-than-life personality and the joy he shows whether practicing or throwing three touchdown passes, he has lifted the Browns. A man of faith, he's made his teammates believe. Winston has done what Watson couldn't: made the Browns better. “A very, very authentic person,” Stefanski said Friday on a Zoom call. “He’s the same guy every single day. He's the same guy at 5 a.m. as he at 5 p.m. He brings great energy to everything he does, and I think his teammates appreciate that about him.” Winston, who is 2-2 as a starter with wins over the Steelers and Baltimore Ravens, has a knack for inspiring through fiery, preacher-like pregame speeches. As I walked through Killarney on a breezy morning, a burst of vibrant colour permeated the winter drizzle. Then my stomach churned with the smell of latex. A huge arch of balloons was attached to a shopfront. Colours bring us joy, but these things are lethal. It’s distressing to see them being used at everything from art exhibitions to political meetings. Balloons burst and land in the sea. Turtles, birds, and whales mistake the litter for jellyfish. When they try to consume the scraps, latex gets lodged in their throats and the creatures slowly starve to death. As for human bellies, microplastics infiltrate the soil to enter our food chain. I ask Dr Silvia Caldararu a botanist at Trinity college, for insights. “Rain washes across surfaces where plastics are found,” she says. “As water flows though the soil, particles move down to the deeper layers with the water flow. The exact effects on plants depend on the type, and especially the size, of plastic particles.” Larger pieces of debris (microparticles) can change the soil texture. “This affects the water and nutrients that are available to plants, often leading to less plant growth and to plants being more susceptible to things like drought. Smaller particles (nanoparticles) are a different story. They can actually be taken up by plant roots and cause toxicity in plants,” Silvia explains. The scientist says that plants need to be studied at bigger scales as well as how they interact with each other and with soil. Most of us consume plants. Our vegetables are affected by toxins in the soil, and balloons are part of the problem. In the nineties I was clueless. Birthdays parties meant balloons. Watery eyes and tomato-red faces. Filling them with air brought fart sounds and squeamish stretching. Knotted rubber. Fingers sore from thumb tacks. My football-crazy son moved balloons with slow-motion kicks and headers. Latex toy balloons have been around since 1931. Last January, for the good of the environment, the European Parliament’s Environment Committee vowed to interfere with the manufacturing process. The toy industry complained, “Perfectly safe balloons, colouring pencils and sturdy trampolines are in danger of disappearing.” But balloons are not safe, even ‘biodegradable’ ones. They can travel for hundreds of miles before exploding at higher altitudes. Strings attached to them can cause birds to get tangled up. Balloons don’t vanish. They take years to decompose. Helium-filled versions with metallic coating can cause an outage or fire if they hit electricity power lines, so California banned them. We don’t need to look to our government for ecological guidance on this. We can simply stop purchasing balloons. Bubbles and flowers There are endless Earth-kinder ways to add colour and celebration to life. Streamers, balloons, and confetti can be replaced with bubbles, which leave no trace. Blowing bubbles is a feelgood activity that spreads smiles in people of all ages who enjoy the shimmering, iridescent, rainbow colours. Floral arrangements are an attractive alternative to tinsel. In Cavan, Kirsten O'Keeffe makes dried flower products for interiors. Children’s parties Parents feel pressurised to buy gifts, so plastic bits and pieces that cost around a tenner are common winter presents. Consider popping a fiver or another note in a card instead. The birthday boy or girl could save up for something that they genuinely want if everyone did this. Cheap toys, costumes, and decorations are soon chucked in the wheelie bin. Goody bags afterwards are not necessary. What matters is that children gather and have fun. If you are adamant that junior revellers bring something home, why not share any leftover party food or give them a packet of seeds to plant? Flickering, dancing flames add a soft glow. Candles create atmosphere. Some companies infuse theirs with essential oils such as lemongrass, orange, and aromatic spices. Soilse in Dundalk and Meath’s Handmade Soap Company are two examples. If you don’t have enough safe spots, or if you dislike candles, white LED lights are lovely substitutes. If you buy new, keep the receipt. The cheapest, made-in-China variety are unlikely to serve you very well or last long. Christmas is a big deal for Christians and other folks like it regardless of their affiliations. Some people choose not to decorate. In the last census over 14% of the population reported having no religion. Over 3,800 people identified as Agnostic or Atheist. Whatever your beliefs, a splash of colour can be uplifting. K illarney was the first town in Ireland to ban single use coffee cups. I wonder if any town will ban balloons. In a world where microplastics are a massive problem it’s heartening to know that we can create a cultural shift by making more conscious consumer choices. Come on, colour lovers: let that be our legacy.It looked like a recipe for disaster. So, when his country's swimmers were being accused of doping earlier this year, one Chinese official cooked up something fast. He blamed it on contaminated noodles. In fact, he argued, it could have been a culinary conspiracy concocted by criminals, whose actions led to the cooking wine used to prepare the noodles being laced with a banned heart drug that found its way into an athlete's system. This theory was spelled out to international anti-doping officials during a meeting and, after weeks of wrangling, finally made it into the thousands of pages of data handed over to the lawyer who investigated the case involving 23 Chinese swimmers who had tested positive for that same drug. The attorney, appointed by the World Anti-Doping Agency, refused to consider that scenario as he sifted through the evidence. In spelling out his reasoning, lawyer Eric Cottier paid heed to the half-baked nature of the theory. "The Investigator considers this scenario, which he has described in the conditional tense, to be possible, no less, no more," Cottier wrote. Even without the contaminated-noodles theory, Cottier found problems with the way WADA and the Chinese handled the case but ultimately determined WADA had acted reasonably in not appealing China's conclusion that its athletes had been inadvertently contaminated. Critics of the way the China case was handled can't help but wonder if a wider exploration of the noodle theory, details of which were discovered by The Associated Press via notes and emails from after the meeting where it was delivered, might have lent a different flavor to Cottier's conclusions. "There are more story twists to the ways the Chinese explain the TMZ case than a James Bond movie," said Rob Koehler, the director general of the advocacy group Global Athlete. "And all of it is complete fiction." In April, reporting from the New York Times and the German broadcaster ARD revealed that the 23 Chinese swimmers had tested positive for the banned heart medication trimetazidine, also known as TMZ. China's anti-doping agency determined the athletes had been contaminated, and so, did not sanction them. WADA accepted that explanation, did not press the case further, and China was never made to deliver a public notice about the "no-fault findings," as is often seen in similar cases. The stock explanation for the contamination was that traces of TMZ were found in the kitchen of a hotel where the swimmers were staying. In his 58-page report, Cottier relayed some suspicions about the feasibility of that chain of events — noting that WADA's chief scientist "saw no other solution than to accept it, even if he continued to have doubts about the reality of contamination as described by the Chinese authorities." But without evidence to support pursuing the case, and with the chance of winning an appeal at almost nil, Cottier determined WADA's "decision not to appeal appears indisputably reasonable." A mystery remained: How did those traces of TMZ get into the kitchen? Shortly after the doping positives were revealed, the Institute of National Anti-Doping Organizations held a meeting on April 30 where it heard from the leader of China's agency, Li Zhiquan. Li's presentation was mostly filled with the same talking points that have been delivered throughout the saga — that the positive tests resulted from contamination from the kitchen. But he expanded on one way the kitchen might have become contaminated, harkening to another case in China involving a low-level TMZ positive. A pharmaceutical factory, he explained, had used industrial alcohol in the distillation process for producing TMZ. The industrial alcohol laced with the drug "then entered the market through illegal channels," he said. The alcohol "was re-used by the perpetrators to process and produce cooking wine, which is an important seasoning used locally to make beef noodles," Li said. "The contaminated beef noodles were consumed by that athlete, resulting in an extremely low concentration of TMZ in the positive sample. "The wrongdoers involved have been brought to justice." This new information raised eyebrows among the anti-doping leaders listening to Li's report. So much so that over the next month, several emails ensued to make sure the details about the noodles and wine made their way to WADA lawyers, who could then pass it onto Cottier. Eventually, Li did pass on the information to WADA general counsel Ross Wenzel and, just to be sure, one of the anti-doping leaders forwarded it, as well, according to the emails seen by the AP. All this came with Li's request that the noodles story be kept confidential. Turns out, it made it into Cottier's report, though he took the information with a grain of salt. "Indeed, giving it more attention would have required it to be documented, then scientifically verified and validated," he wrote. Neither Wenzel nor officials at the Chinese anti-doping agency returned messages from AP asking about the noodles conspiracy and the other athlete who Li suggested had been contaminated by them. Meanwhile, 11 of the swimmers who originally tested positive competed at the Paris Games earlier this year in a meet held under the cloud of the Chinese doping case. Though WADA considers the case closed, Koehler and others point to situations like this as one of many reasons that an investigation by someone other than Cottier, who was hired by WADA, is still needed. "It gives the appearance that people are just making things up as they go along on this, and hoping the story just goes away," Koehler said. "Which clearly it has not."

Deputy national security adviser Anne Neuberger offered new details about the breadth of the sprawling Chinese hacking campaign that gave officials in Beijing access to private texts and phone conversations of an unknown number of Americans. White House officials cautioned that the number of telecommunication firms and countries impacted could grow. The U.S. believes the hackers were able to gain access to communications of senior U.S. government officials and prominent political figures through the hack, Neuberger said. “We don’t believe any classified communications has been compromised,” Neuberger added during a call with reporters. She added that Biden was briefed on the findings and the White House “made it a priority for the federal government to do everything it can to get to the bottom this.” US officials recommend encrypted messaging apps amid "Salt Typhoon" cyberattack, attributed to China, targeting AT&T, Verizon, and others. The Chinese embassy in Washington rejected the accusations that it was responsible for the hack Tuesday after the U.S. federal authorities issued new guidance. “The U.S. needs to stop its own cyberattacks against other countries and refrain from using cyber security to smear and slander China,” embassy spokesperson Liu Pengyu said. The embassy did not immediately respond to messages Wednesday. White House officials believe the hacking was regionally targeted and the focus was on very senior government officials. Federal authorities confirmed in October that hackers linked to China targeted the phones of then-presidential candidate Donald Trump and his running mate, Sen. JD Vance, along with people associated with Democratic candidate Vice President Kamala Harris. The number of countries impacted by the hack is currently believed to be in the “low, couple dozen,” according to a senior administration official. The official, who spoke on the condition of anonymity under rules set by the White House, said they believed the hacks started at least a year or two ago. The suggestions for telecom companies released Tuesday are largely technical in nature, urging encryption, centralization and consistent monitoring to deter cyber intrusions. If implemented, the security precautions could help disrupt the operation, dubbed Salt Typhoon, and make it harder for China or any other nation to mount a similar attack in the future, experts say. Trump's pick to head the Federal Bureau of Investigation Kash Patel was allegedly the target of cyberattack attempt by Iranian-backed hackers. One easy way to safeguard yourself against these breaches is to use a virtual private network, or VPN, while traveling. VPNs are apps that encrypt your data and hide your location, preventing hackers from accessing personal information. An added bonus is that VPNs allow you to access websites that may be blocked or unavailable in the country you are visiting. To use a VPN, simply download a VPN app on your phone or computer, create an account, choose a server, and connect. If your phone falls into the wrong hands, there's a good chance you won't be getting it back. Out of those 91,000 phones stolen in London in 2022, only 1,915 (or about 2%) were recovered. The good news is that you can take precautions to make the loss of your phone less devastating by backing up your data before you travel. With backed-up data, you can acquire a new device and still access your photos, contacts, messages, and passwords. Moreover, if you have "Find My Device" or "Find My Phone" enabled, you can remotely wipe your stolen phone's data so the thief cannot access it. It's safest to back up your data to a hard drive and not just the cloud. That way, if you have to wipe your device, you don't accidentally erase the backup, too. In order for the previous tip on this list to work, "Find My Phone" must be turned on in advance, but remotely wiping your device isn't the only thing this feature allows you to do. The "Find My Phone" feature enables you to track your device, as long as it's turned on and not in airplane mode. This is particularly helpful if you misplaced your phone or left it somewhere since it can help you retrace your steps. While this feature won't show you the live location of a phone that has been turned off, it will show the phone's last known location. With "Find My Phone," you can also remotely lock your phone or enable "Lost Mode," which locks down the phone, suspends any in-phone payment methods, and displays contact information for returning the phone to you. If your phone was stolen, experts caution against taking matters into your own hands by chasing down the thief, since this could land you in a potentially dangerous situation and is unlikely to result in getting your phone back. Brandon Allen will start at quarterback for San Francisco. This is a tough outcome for the Niners. They are 5-5 and will be playing at a snowy Lambeau Field against a 7-3 team. A loss would place the Niners below .500 with only six remaining games to make up the ground. Purdy not being available for the game is not too surprising given his limited ability to practice this week due to a shoulder injury. Team GM John Lynch also had said that Allen would start at quarterback and Josh Dobbs would serve as a backup if Purdy were unavailable. Purdy, who is in his third season with San Francisco, has passed for 2,613 yards, 13 touchdowns and 8 interceptions this season. He has also rushed for 267 yards and 4 touchdowns. Allen does not have any stats this season, but he has passed for 1,611 yards, 10 touchdowns and 6 interceptions during his NFL career. He achieved most of his stats with the Cincinnati Bengals from 2020-2021. The good news for Allen is that tight end George Kittle has said he will battle through a hamstring injury and play in the game. Bosa will miss the game due to a hip injury. LOS ANGELES — The UCLA women’s basketball team rode a dominant first half to knock off No. 1 and defending national champion South Carolina, 75-60, on Sunday, ending the Gamecocks’ overall 43-game winning streak and their run of 33 consecutive road victories. The Gamecocks (5-1) lost for the first time since April 2023, when Caitlin Clark and Iowa beat them in the NCAA Tournament national semifinals. The No. 5 Bruins welcomed South Carolina to a sold-out Pauley Pavilion in the best way they knew possible: Gamecocks star Chloe Kitts went up for a jumper just in time for 6-foot-7 center Lauren Betts to get a hand on the ball for a forceful block that sent Kitts to the floor as the opening quarter came to a close. The Bruins had double the amount of points as the Gamecocks in that moment. And yet, UCLA head coach Cori Close wanted more of her team: “Whatever the score is,” she told the crowd at halftime, “I know we can play better.” Betts continues to average a double-double and recorded 11 points and 14 rebounds in the game. Londynn Jones scored 15 points and was a perfect 5-for-5 from 3-point range. Elina Aarnisalo and Gabriela Jaquez also finished in double-digit scoring with 13 and 11 points, respectively. South Carolina was scoring an average of 45.6 points in the paint heading into the game, but UCLA had limited them to 18. The Bruins shook off a choppy start in which the shots weren’t falling and took off on an 11-0 run in the first quarter. It was unclear who would start at point guard between freshman Elina Aarnisalo and Kiki Rice, who was day-to-day with an injury. UCLA had both of them in the starting rotation and reaped benefits from Rice’s scoring abilities and Aarnisalo’s IQ. The Finnish hooper had a steal that led to a layup for UCLA’s first points of the game and she continuously came up with athletic plays throughout the game. She hit a midrange jumper and a 3-pointer from the top of the key in a matter of three minutes in the second quarter as the Bruins entered the break with a 43-22 advantage. The Gamecocks found rhythm in transition as they trudged on but were unable to put together a run of more than five points at a time. They switched their offensive attack to the perimeter but saw little success. Meanwhile, UCLA’s success from range grew. Jones made a shot from beyond the arc to keep the Bruins ahead by 20 points and Janiah Barker made a three of her own shortly after to extend the lead to 57-36.
