The EU is investigating the Chinese shopping app over suspicions it's failing to protect its customers. Coming under the bloc's Digital Services Act, can the probe slow Temu's race to the top of online shopping? Confronting Temu with the EU's allegations is like doing business with the popular Chinese shopping app . It would take the length of this article just to line up the many pieces of information DW has received from Temu, one of which was Temu's standard phrase about "cooperating fully with [EU] regulatory authorities." Temu appears to be used to responding to allegations, most probably because the company is constantly confronted with them. In early 2024, the European Toy Association found safety risks in 95% of children's toys sold on Temu. The German Consumer Protection Association has repeatedly issued warnings, with the last such formal notice to stop its unlawful behavior or face a lawsuit sent this spring. In October, the pressure on Temu increased again after the European Commission launched a formal investigation into the shopping platform's business model. Prominent on the EU executive arm's long list of complaints is the claim that Temu is exporting products to the EU that do not comply with the bloc's standards. Moreover, the Commission accuses the online retailer of offering fake discounts to customers, publishing fake reviews, insufficient vendor information , and having an addictive app design. What's Temu's business model? Outside of China, Temu first emerged in the United States in September 2022 with the claim it wants to give Americans greater access to Chinese products. Since then, the marketplace has experienced rapid growth not only in the US but at a global level. From teeth-whitening powder to garden shears, Temu offers thousands of items at unbeatable prices. The products it sells usually arrive in various separate shipments directly from China. It is estimated that in Germany alone, 400,000 packages from Temu and the Chinese fashion marketplace Shein arrive every day. Temu is in a position to offer its products at unbeatable bargain prices because it operates solely as a marketplace, meaning Temu customers usually receive their package directly from a manufacturer's or seller's warehouse in China. Temu only handles the financial transactions and, in some cases, the shipping. In any case, Temu acts only as an intermediary, earning a commission for its services. This setup allows Temu to forgo stocking inventory almost entirely, thus reducing its costs. In turn, the practice also means longer delivery times for customers. Alexander Graf, a German platform-economy expert, says longer delivery times are key to Temu's low-price business model. "The Western e-commerce industry has evidently focused too long on shorter delivery times," said Graf, who is co-founder and co-CEO of Spryker, a software firm for e-commerce based in Berlin and New York. Apart from that, Temu's app "encourages consumers to shop more frequently," he told DW. Temu's strategy seems to be working nicely, given that it was the most downloaded iPhone app in the US in 2023, according to Apple. But Amazon is "struggling to compete with Temu on its main platform," he added. Who owns Temu? The owner of the shopping app that has alarmed consumer advocates, Amazon, and the European Union is PDD Holdings. Listed on the US tech exchange Nasdaq, the firm noted the Irish capital of Dublin as its "principal executive office" in a 2023 filing with the US Securities and Exchange Commission (SEC). It had previously listed Shanghai as its main office. PDD's key brand is the e-commerce platform Pinduoduo, owned by Chinese billionaire Colin Huang. The EU Commission investigation has given Temu until early December to offer so-called remedies and make adjustments to its business model. If it fails to comply, the platform will face hefty fines. EU taxation policy helps Temu advance A major issue not addressed by the EU probe, however, is Temu's practice of exporting its goods to Europe largely duty-free. Under EU rules, shipments valued at under €150 can be imported without paying any tariff, says taxation expert Roger Gothmann, who believes that Temu's success relies hugely on exploiting the loophole. "A large portion of shopping baskets on Temu stays under €150. Without this [duty-free] threshold, Temu couldn't offer such low prices," he told DW. The CEO of Taxdoo, a Hamburg, Germany-based company offering accounting and VAT software for online merchants, believes closing the loophole could potentially slow down Temu's growth in Europe. The Nevada Gaming Control Board gave the greenlight Wednesday morning to a newly formed entity — C&C 4455 — to take over the day-to-day casino operations of the off-Strip casino property. C&C 4455 is comprised of Cliff Atkinson and Chad Konrad, the property’s president and chief financial officer, respectively. Atkinson will assume the role of chief executive officer while Konrad will continue as CFO, a position he has held at the property since it was known as the Hard Rock Hotel. The Nevada Gaming Commission must approve the changes before they become final. The two veteran gaming executives told the NGCB that with Mohegan Gaming’s departure as the casino operator, friction points separating Virgin’s hotel, gaming and resort operations would be removed, thereby creating a more streamlined guest experience. The goal, they said, is stability. “Since reopening (as Virgin Hotels Las Vegas in 2021), the property has struggled. I think that’s pretty public and well known,” Atkinson said Wednesday morning in Las Vegas. “The deal with Mohegan simply did not work....The reason we are here (seeking approval of C&C 4455) is to successfully turn the gaming operations around.” Atkinson outlined a long-term plan for Virgin’s success that includes an appeal to locals, the activation of “dead spaces” on the property by bringing in new entertainment and amenities for guests, and the creation of a new customer loyalty program. He said there was an opportunity to return value to the Las Vegas casino market. “We both have a similar belief in the property, in the casino specifically and in our ability to really drive this casino from a performance standpoint forward and to keep this thing running, keep the doors open on this thing,” Konrad told the three-member gaming board. Culinary, Virgin unable to come to terms Prior to testimony from Atkinson and Konrad, members of Culinary Union Local 226 implored the board to question the gaming executives about the property owner’s financial situation, which they believe is being misrepresented as a means to avoid negotiating in good faith. Culinary 226 has engaged in an open-ended strike that began on Nov. 15 , making it the longest labor demonstration in recent memory. Ted Pappageorge, the union’s treasurer and secretary, told the board that Virgin employees have been working under contract conditions that expired 18 months ago. The union is reportedly seeking a new contract comparable to those offered at other off-Strip casinos, such as Westgate, Sahara, Rio and The Strat. Despite multiple negotiations, the two sides have been unable to come to terms. “Unfortunately, we have a company that is unwilling to settle the standards that we have negotiated in Las Vegas. They are the final remaining company that has not come to the table with a fair contract,” Papageorge said. The union believes that Virgin’s ownership is more than capable of meeting contract demands. The property’s ownership group includes a multi-billion-dollar Canadian-based pension fund, a private equity firm called Juniper Capital Management and British billionaire Sir Richard Branson’s Virgin Group. Union member and Virgin employee Paul Catha said Nevada has a “complicated relationship” with billionaire institutions and individuals, and questioned why no one from the ownership group was present Wednesday to speak about the newly formed casino operation entity. “Why would Nevada not require the owners of Virgin Las Vegas to be included in a review of the resort’s own licensed casino operation application?” Catha asked. “We believe Nevada gaming regulators should ask broader and deeper questions about sources of funds and ultimate control at Virgin Las Vegas.” NGCB Chair Kirk Hendrick indirectly addressed those concerns during the testimony of Atkinson and Konrad, alluding to an investigative document that was “a couple of inches thick,” suggesting that regulators had conducted due diligence on both the executives and the ownership group. For now, the union’s strike will continue. “These companies have extremely deep pockets,” Papageorge said of Virgin’s ownership group. “So the idea that these Canadian economic entities would come to Las Vegas to try to destroy our standards of living that we’ve worked for decades to build is just unacceptable...and if they don’t agree to Vegas standards, (they should) go back to Canada.” The casino dismissed the union’s talking points. “The Culinary Workers Union Local 226 continues to bargain in bad faith – repeatedly refusing to engage in meaningful negotiations with us since January 2024 – and nothing has changed. Despite Virgin Hotels Las Vegas agreeing to many of the Culinary Union leadership’s demands and showing flexibility on critical sticking points, the Culinary Union has not seriously countered any of our economic proposals, nor even brought our latest offer to their members for a formal vote,” the casino said in a statement, later adding that union “leadership’s current demand is not financially sustainable for Virgin Hotels Las Vegas, and we will not agree to the same contract that led to layoffs at other properties. Authorities in Romania have revealed details of what appears to be a major attempt to interfere in the country’s presidential elections using the social media platform TikTok, and with a series of cyber-attacks. Romania's domestic intelligence service says there are signs the effort was "co-ordinated by a state-sponsored actor". Calin Georgescu, a far-right Nato-sceptic who has previously praised Vladimir Putin, was almost unknown in Romania until he won the first round of voting in the presidential elections two weeks ago. Now Romanian intelligence says his sudden and surprise surge in popularity is down to a "highly organised" and "guerrilla" campaign on social media, sharing identical messaging and using influencers. They say it was conducted from "external locations" to bypass controls. A separate intelligence assessment says that Romania has been identified as an "enemy state" by Moscow and a priority target for what it calls "aggressive hybrid actions". The politically explosive information – which has landed just days before the second round of voting - comes from declassified documents published this evening by the outgoing president, Klaus Iohannis. They reveal how paid content supporting Georgescu was promoted on TikTok, without being marked as election campaigning – in violation of the platform’s own rules and of Romanian electoral law. Other candidates’ content was subject to closer controls. Georgescu has always said he spent "zero" on election promotion, denying he was even campaigning. But the intelligence documents identify one TikTok account which they say made payments of $381,000 (£299,819; €361,872) in just one month from 24 October – to users who were promoting Georgescu. Georgescu claims the release of the documents is a coordinated attempt to block his candidacy. “I think it’s the first time in the history of the world when a state is organising an action against a candidate to stop him from running,” he said in a TV interview on Wednesday. He also denied knowing any of the influencers or funders mentioned in the reports. The documents released in this highly unusual move were all papers drawn up for a meeting of the security council following the first round of the presidential election. They also reveal that access data for electoral websites was stolen from legitimate users and published online “on cyber-crime platforms originating from Russia”. Separately, the intelligence agencies report some 85,000 attempted hacks in an attempt to access electoral data and change content – including on election day. The report says the cyber-attackers used advanced methods to remain anonymous, working in a way and on a scale "typical of state-sponsored actors". Far-right frontrunner Georgescu is due to face reformist candidate Elena Lasconi in a second round vote on Sunday. Romanian Prime Minister Marcel Ciolacu – who came 3rd in the presidential race – has now announced he will "fully endorse" Elena Lasconi. But that’s assuming the vote goes ahead. The prosecutor’s office is now examining the new documents. "I hope that, based on the evidence published today, the state authorities will take appropriate action, and all those responsible will be held accountable," Ciolacu said. He added that people's votes have shown they want the "continuation of Romania's European development path". A pro-EU protest has been called for Thursday evening. Commenting on the protest, Georgescu warned against possible unrest, citing the "Maidan" in Ukraine - the revolution of 2014 that ousted a pro-Russian president. (Reuters) -A suspected gunman shot and wounded two children at a California elementary school on Wednesday before shooting himself dead, local media reported, citing police officials. The shooting occurred at Feather River School of Seventh-Day Adventists in Palermo, California, north of Sacramento, the Butte County Sheriff's office said on social media. "The suspected shooter is deceased," the sheriff's office said in a post on X. It said students were being taken to a nearby church, but did not provide details on any harm to students or faculty.
