That’s not true, according to a new court filing from the social media company formerly known as Twitter. It’s an argument that X is making in order to throw a wrench in The Onion’s recent purchase of InfoWars, the conspiracy theory media company run by Alex Jones. And it’s a great reminder that you don’t actually own what you think you own in the digital age. The people behind the Onion recently won InfoWars in an auction , sold as part of a legal judgment against Jones who was found guilty of defaming the families of teachers and students who were killed at Sandy Hook Elementary School in 2012. The families won a $1.4 billion judgment against Jones and selling off InfoWars was part of the liquidation process for the conspiracy theorist’s assets in order to pay down that debt. But a company tied to Jones has challenged the validity of the Onion’s purchase. And X is trying to help stop the sale. X’s legal filing on Monday, posted online by 404 Media , argues that all of the social media accounts in the auction can’t be transferred. “Put simply, accounts are inherently part of X Corp.’s Services and their ‘use,'” the company said in Monday’s court filing . “A user must use X Corp.’s Services to create an account in the first instance, and to continue using the account going forward.” X insists it wasn’t claiming ownership of the content in the accounts, and is only saying it controls the accounts themselves. “While X Corp. takes no position as to the sale of any Content posted on the X Accounts, X Corp. is the sole owner of the Services being sold as part of the sale of the X Accounts,” the social media company wrote in its court filing. “While X Corp. has granted account holders, such as Jones and FSS, a license to use the Services, such license is non-assignable, both under the terms of the TOS and applicable non-bankruptcy law (i.e., as a personal services contract), and the Trustee cannot sell, assign, or otherwise transfer such license absent X Corp.’s consent.” As 404 Media notes, it’s pretty standard for social media accounts to be transferred to new companies when a brand is sold. And Musk himself even threatened to reassign NPR’s X handle back in 2023 after the media outlet briefly stopped posting when the billionaire started labeling the broadcaster as state media. Oddly enough, X is essentially state media now that Musk has been named to an unofficial commission called DOGE that threatens to strip the federal budget of $2 trillion. Musk has, of course, donated millions to Donald Trump and helps boost far-right voices on the site in an effort to help the once and future president. It’s not unexpected that Musk and his ilk would try to help a fellow far-right conspiracy theorist like Jones. But it would certainly be strange to explain this exact scenario to someone in late 2022 when Musk first bought Twitter. At the time, Musk was hesitant to allow Jones back on the social media platform after he had been banned years earlier. Musk specifically said at the time that he wouldn’t allow Jones back on Twitter because his first child died and suggested that Jones had caused too much pain to grieving parents after the Sandy Hook massacre. “My firstborn child died in my arms. I felt his last heartbeat. I have no mercy for anyone who would use the deaths of children for gain, politics or fame,” Musk tweeted on Nov. 20, 2022 , roughly a month after buying the platform. Obviously, that changed and Musk allowed Jones back on the platform. And now he’s going so far as to throw a wrench in The Onion’s purchase of InfoWars, which was enabled with the blessing of the Sandy Hook families, who lost twenty children and six staff when a mass shooter entered the school over a decade ago. Musk, as the world’s richest person with $348 billion, has no actual principles beyond self-interest, making him a perfect fit for the MAGA agenda. And he’s going to utilize his power to keep guys like Jones from feeling any inconvenience in the name of helping Trump. X didn’t respond to an email sent Tuesday afternoon. The family was fairly well off by local standards, living in a well-kept, two-story house with a front patio and a wide veranda. Experts say illegal immigration from India is driven by everything from political repression to a dysfunctional American immigration system that can take years, if not decades, to navigate legally. Much is rooted in economics and how even low-wage jobs in the West can ignite hopes for a better life. Before the jury’s conviction on Friday, the federal trial in Fergus Falls, Minnesota, saw testimony from an alleged participant in the smuggling ring, a survivor of the treacherous journey across the northern border, border patrol agents and forensic experts. Defense attorneys were pitted against each other, with Shand’s team arguing that he was unwittingly roped into the scheme by Patel. Patel’s lawyers, The Canadian Press reported , said their client had been misidentified. They said “Dirty Hary,” the alleged nickname for Patel found in Shand’s phone, is a different person. Bank records and witness testimony from those who encountered Shand near the border didn’t tie him to the crime, they added. Prosecutors said Patel coordinated the operation while Shand was a driver. Shand was to pick up 11 Indian migrants on the Minnesota side of the border, prosecutors said. Only seven survived the foot crossing. Canadian authorities found two parents and their young children later that morning, dead from the cold. The trial included an inside account of how the international smuggling ring allegedly works and who it targets. Rajinder Singh, 51, testified that he made over $400,000 smuggling over 500 people through the same network that included Patel and Shand. Singh said most of the people he smuggled came from Gujarat state. He said the migrants would often pay smugglers about $100,000 to get them from India to the U.S., where they would work to pay off their debts at low-wage jobs in cities around the country. Singh said the smugglers would run their finances through “hawala,” an informal money transfer system that relies on trust. Offense was at a premium all afternoon. The run game was cooking on both sides as there was a total of 462 combined yards on the ground for the game. The Tigers and Antelopes scored on each of the first seven drives of the game, there wasn’t a stop to be had defensively for nearly three quarters. When a stop did happen, it was in a big spot. Up by six, Northwestern Lehigh registered the first defensive stop of the game when Micheal Lagowy that Eli Zimmerman recovered. Zimmerman later punched it in from one yard out, giving the Tigers a 14-point lead. The Lopes looked dead in the water after the 13-point swing. Avonworth Luca Neal changed that quickly. The move, announced in court papers, marks the end of the Justice Department’s landmark effort to hold Mr Trump accountable for what prosecutors called a criminal conspiracy to cling to power in the run-up to his supporters’ attack on the US Capitol on January 6 2021. In court papers, prosecutors said the Justice Department’s position “is that the Constitution requires that this case be dismissed before the defendant is inaugurated”. Mr Smith’s team emphasised that the move to abandon the prosecutions, in federal courts in Washington and Florida, was not a reflection of their view on the merits of the cases but rather a reflection of their commitment to longstanding department policy. “That prohibition is categorical and does not turn on the gravity of the crimes charged, the strength of the Government’s proof, or the merits of the prosecution, which the Government stands fully behind,” the prosecutors wrote in Monday’s court filing in the election interference case. The decision was expected after Mr Smith’s team began assessing how to wind down both the 2020 election interference case and the separate classified documents case in the wake of Mr Trump’s victory over Vice President Kamala Harris. The Justice Department believes Trump can no longer be tried in accordance with longstanding policy that says sitting presidents cannot be prosecuted. Mr Trump has cast both cases as politically motivated and has vowed to fire Mr Smith as soon as he takes office in January. The 2020 election case brought last year was once seen as one of the most serious legal threats facing the Republican as he vied to reclaim the White House. However, it quickly stalled amid legal fighting over Mr Trump’s sweeping claims of immunity from prosecution for acts he took while in the White House. The US Supreme Court in July ruled for the first time that former presidents have broad immunity from prosecution, and sent the case back to US District Judge Tanya Chutkan to determine which allegations in the indictment, if any, could proceed to trial. The case was just beginning to pick up steam again in the trial court in the weeks leading up to this year’s election. Mr Smith’s team filed a lengthy brief in October laying out new evidence they planned to use against him at trial, accusing him of “resorting to crimes” in an increasingly desperate effort to overturn the will over voters after he lost to President Joe Biden.In a net positive for researchers testing the security and safety of AI systems and models, the US Library of Congress ruled that certain types of offensive activities — such as prompt injection and bypassing rate limits — do not violate the Digital Millennium Copyright Act (DMCA), a law used in the past by software companies to push back against unwanted security research. The Library of Congress, however, declined to create an exemption for security researchers under the fair use provisions of the law, arguing that an exemption would not be enough to provide security researchers safe haven. Overall, the triennial update to the legal framework around digital copyright works in the security researchers' favor, as does having clearer guidelines on what is permitted, says Casey Ellis, founder and adviser to crowdsourced penetration testing service BugCrowd. "Clarification around this type of thing — and just making sure that security researchers are operating in as favorable and as clear an environment as possible — that's an important thing to maintain, regardless of the technology," he says. "Otherwise, you end up in a position where the folks who own the [large language models], or the folks that deploy them, they're the ones that end up with all the power to basically control whether or not security research is happening in the first place, and that nets out to a bad security outcome for the user." Security researchers have increasingly gained hard-won protections against prosecution and lawsuits for conducting legitimate research. In 2022, for example, the US Department of Justice stated that its prosecutors would not charge security researchers with violating the Computer Fraud and Abuse Act (CFAA) if they did not cause harm and pursued the research in good faith. Companies that sue researchers are regularly shamed, and groups such as the Security Legal Research Fund and the Hacking Policy Council provide additional resources and defenses to security researchers pressured by large companies. In a post to its site, the Center for Cybersecurity Policy and Law called the clarifications by the US Copyright Office "a partial win" for security researchers — providing more clarity but not safe harbor. The Copyright Office is organized under the Library of Congress's purview. "The gap in legal protection for AI research was confirmed by law enforcement and regulatory agencies such as the Copyright Office and the Department of Justice, yet good faith AI research continues to lack a clear legal safe harbor," the group stated . "Other AI trustworthiness research techniques may still risk liability under DMCA Section 1201, as well as other anti-hacking laws such as the Computer Fraud and Abuse Act." The fast adoption of generative AI systems and algorithms based on big data have become a major disruptor in the information-technology sector. Given that many large language models (LLMs) are based on mass ingestion of copyrighted information, the legal framework for AI systems started off on a weak footing. For researchers, past experience provides chilling examples of what could go wrong, says BugCrowd's Ellis. "Given the fact that it's such a new space — and some of the boundaries are a lot fuzzier than they are in traditional IT — a lack of clarity basically always converts to a chilling effect," he says. "For folks that are mindful of this, and a lot of security researchers are pretty mindful of making sure they don't break the law as they do their work, it has resulted in a bunch of questions coming out of the community." The Center for Cybersecurity Policy and Law and the Hacking Policy Council proposed that red teaming and penetration testing for the purpose of testing AI security and safety be exempted from the DMCA, but the Librarian of Congress recommended denying the proposed exemption.
